Complaint: My complaint is in regard to Fay Servicing, ( FayServ ), a debt collector, who is handling my mortgage for XXXX. FayServ has been charging me late payment fees not in compliance with their late payment fee policy.
FayServ 's policy, which is clearly noted on my monthly statement, says, " If payment is received after XXXX, {$150.00} late fee will be charged. ". However, the statement date is also displayed on the statement. Looking over all my statements in question, it shows that all statements, for subsequent months, are generated prior to the XXXX of the month, most often the XXXX or XXXX. The latest statement date, on my statements in question, was the XXXX. Therefor, even if payment is received by the XXXX or XXXX, it would indicate on the next months statement that the previous months payment was not received, therefor, adding a " PAST DUE '' and late fee amount to the next months statement.Therein lies the issue. The late fee is not returned. In my case this occurred four consecutive months, XX/XX/XXXX ( {$140.00} ), XX/XX/XXXX ( {$120.00} ), XX/XX/XXXX ( {$110.00} ) and XX/XX/XXXX ( {$110.00} ). That is a total of {$490.00}. of late fees that should not have been charged. All due to monthly statements being generated " prior '' to the XXXX of the month.
I contacted my designated point of contact at FayServ each month this occured. She said she would look into it and " get back to me ''. However, she has never initiated contact with me with any resolve or explanation regarding this issue. The last time I managed to contact her, she said, if " they '' do n't get " my '' payment deposited by the XXXX, regardless of the date " they '' receive " my '' payment, " I '' will be charged a late fee. I was n't in agreement with her statement and asked to speak to her supervisor, she stated, " he is in a meeting and she would have him call me '', I have not heard from him.
I have been sending my payments through my credit union bill pay service. A month or two after starting this method of payment, I noticed it took as much as 3-4 days, after the payment was transferred electronically, before the funds were deducted from the account. I contacted my credit union to discover that FayServ does not take direct payment, they only take electronic checks when the customer chooses this method of payment. My bank statements and bill pay records clearly show that the latest any payment has been sent this year is XXXX/XXXX/16. Typically, payments, for the months in question, XX/XX/XXXX-XX/XX/XXXX, are forwarded electronically, between the XXXX and XXXX with funds deducted form my account no later than the XXXX. Therefore, according to FayServ policy, I have not been " late '', but they still charge a late fee.
So, my complaint in summery, FayServ is improperly charging late fees and not refunding them. FayServ inappropriately generates monthly statements prior to the XXXX of the month, negating compliance with their policy. FayServ does not credit my payment in an appropriate and timely manner. So, I would like FayServ to comply totheir policy and return my {$490.00}.

Complaint: I have attempted several times ( 6 or more in the past 3-4 months to get a a loan modification package. My loan was sold to Fay Servicing while I was in the middle of a modification review with my prior lender. I get letters almost daily of a new acct manager in which I call and to no avail can reach live. I leave a message and do not receive call backs to answer my questions. I call the toll free telephone # and told I have yet another account manager. the lender stated to the courts they tried contacting me and serving my household since XXXX 2016 with no success. they got permission from the courts to serve publicly in the paper. There is someone at my house 24x7 and there were NO attempts to serve me. my home is going up for aution on XXXX/XXXX/16 and I have yet to get a call back from any of the many acct managers I was assigned. I also requested the investors contact information, telephone number and mailing address in which I was denied.

Complaint: I have been trying to complete a loan modification with my lender for 2 years and am continually lied too. They send me a letter, emails, and verify by phone that all the information has been received and under review and then a few days to weeks later I get a call that the information is not complete and I get denied. I have gone through this at least 3 times with the latest being today. I received a letter of denial because they claim the documents are not complete after I have received a letter stating it has all been received. Then I get a call from a new account manager telling me it is not and is completely unaware that the letter has been received. I respond to that via phone and the new account manager looks at the received documents and tells me it was his oversight and that they have what they need. About 5 days later I get another call from another account manager that is supposedly helping my account manager and he tells me that they need more documents, newer versions of what I already sent them because they took too long to review them. So, I submit them again and receive an email confirming they are received.
Today I get the letter that states otherwise. I keep getting lied to and have done some research on my lender and this is business as usual for them. I need someone to intervene and keep them honest and force then to do what the government has put into place. I am convinced they are are more concerned with forcing me out of my home than working to keep me in it.

Complaint: Throughout XX/XX/XXXX I sent information to try to get a loan modification. After submission of the loan modification package, my account manager, XXXX, would say that there was a piece that he did not receive. I would fax it again and he would tell me that he still needed another piece of information. The last time he told me that all I needed to send him was the XXXX. Faxed it to him and never heard back. I left several messages but did not receive a call back. Finally I called in and one of the workers told me XXXX was no longer my account manager. My new account manager was XXXX. Left several messages for XXXX, but never received a call back. XXXX, I had my husband withdraw money from his retirement account to bring everything current. When I went online to pay my property taxes in XX/XX/XXXX, FayServicing had already paid them on XXXX/XXXX/XXXX.
On XXXX XXXX, XXXX I called FayServicing to pay all past due amounts and to bring the loan current as of XXXX XXXX, XXXX. Spoke to XXXX who told me that to bring the loan current to XXXX XXXX, XXXX including all late fees, would be {$1000.00}.
The mortgage statements dated XXXX/XXXX/XXXX and XXXX/XXXX/XXXX indicated that my next payment would be due on XXXX/XXXX/XXXX in the amount of {$160.00}. Called in on several occasions was transferred to XXXX, my new account manager, left message but never received a return call. Spoke to XXXX on XXXX XXXX and explained that I needed to talk to someone so that I could make my XXXX payment and they could straighten out this mess with my account. He promised to leave a detailed message with XXXX and would have him to call me back. Never received a call back. Called in on Tuesday and asked for XXXX 's supervisor. Spoke to XXXX XXXX and explained that the payments made on XXXX XXXX, XXXX were for Tax payments and to bring the account current through XXXX XXXX, XXXX. He said that he would contact XXXX and get everything straight and for me to call him back on Friday XX/XX/XXXX after XXXX. Called him back, got his voicemail. Left message for him to call me back on my cell phone because I did not want to make my XX/XX/XXXX payment late but also did not want to send in more money when they had made a mess with the previous payment On XXXX XXXX we looked at the website and there had still been no correction. There was an additional charge for {$72.00}. This prompted us to email XXXXXXXXXXXX. In response we received a letter dated XXXX/XXXX/XXXX which stated that they had received our correspondence and that we would receive a response back in writing with our resolution within 30 business days. ( Still have not received that response.
Then on XXXX/XXXX/XXXX ( exhibit XXXX ) we receive a " Making Home Affordable '' packet. Really!!! I had already tried that last year! Then we received correspondence dated XXXX/XXXX/XXXX more information regarding the Home Affordable Modification Program. The second page of this document shows the " Activity Since Your Last Statement ( XX/XX/XXXX-XX/XX/XXXX* ) '' It is totally confusing. It shows 4 payment correction for XXXX/XXXX/XXXX for {$770.00}, {$770.00}, {$480.00}, {$480.00} ) Then we receive an Escrow Account Disclosure Statement dated XXXX/XXXX/XXXX ( exhibit B ) that there is an overage in the Escrow Account and that we would be receiving a refund of {$640.00}. ( Never received that check ). On XXXX/XXXX/XXXX called Fay Servicing again and spoke to XXXX. Ask for supervisors numbers left message. Still no call back.
Then we receive a letter dated XXXX/XXXX/XXXX that the loan is in default. It shows that we owe for XX/XX/XXXX through XX/XX/XXXX along with late fees, a corporate Advance Balance for a total of {$2600.00} that has to be paid by XXXX/XXXX/XXXX. They are threatening acceleration of the note which would end in FORECLOSURE.
We are both extremely frustrated with the non service that we have received. PLEASE HELP US SAVE OUR HOME!

Complaint: My Mortgage went from {$560.00} to {$700.00}. I was told that it was increased because they escrowed my delinquent taxes. I did not have any delinquent taxes. I was told if I sent a copy of my paid taxes they would refund my money. They only paid the amount due, {$320.00}. I asked if I could simply refund them, which I have. However, I have sent XXXX faxes with a copy of my taxes and asked them to stop the escrow as they said they were escrowing the amounts for next year as well which is why the fee was so high. Plus interest. I have been trying to get in touch with an account manager, who is never in. I leave voice mail messages which are never returned. The first account manager at least talked to me, even if he was lying. But I have had XXXX different managers in the last 6 months and this XXXX is the worst as he never returns my calls.

Complaint: I am currently in default on my mortgage loan due to current situation. I have been trying to pursue a short sale with Fay Servicing ( loan servicer ) since last year and they are preventing me from completing the process along with XXXX XXXX ( investor ). At some point in XX/XX/XXXX the short sale was approved at {$280000.00} and the buyer was unable to close the deal due to the fact that I had squatters in my property. By the time that we were able to evict them, the approval expired and the lender did not honored the approval. In XXXX XXXX, XXXX XXXX XXXX acquired my loan and they had expressed their desire to keep the property since it is located in XXXX which a mortgage market on the rise and they rather F/C on the property to keep it and make profit. I wonder if they ever realized how much stress tis situation has caused me and my family. Do they even have any type of consideration for the customer? As anybody else, I bought this property back in XX/XX/XXXX and I never thought for a minute that I will be in this situations. The previous buyer walked and every time we get an offer, the buyers get turn down by the loan servicer ( Fey Servicing ). I know the investor makes the final decision and they do not care about me or my family, but it will be a great help for us to be consider for a short sale at a realistic market price. We have provided all kind of supporting documentation to support numbers and the investor is NOT willing to allow me to work a short sale. They are forcing us to do a deed in lieu. We have been told my XXXX XXXX XXXX ( Fey servicing - negotiator ) that the investor wants to sit on the property until the foreclosure is completed, so they can keep it, fix it and make a profit on it. I do not believe is right for an investor to do so by preventing me and my family to close this chapter. The investor ( XXXX XXXX ) is denying me the right to do a short sale. Lastly, please keep in mind that they are using a value from from XX/XX/XXXX and they are not willing to do a BPO due to the fact that they know this property is in really bad shape and they will have to sell it at a price that is lower than their expected price. The short sale was previously approved by the previous investor for {$310.00} and now the new investor is asking for {$500000.00}. My questions is if the previous investor using the same BPO approved at {$310000.00} why is the new investor using the same BPO is asking for {$500000.00}? You can tell they have their own intentions and are not willing to help our situation.

Complaint: My name is XXXX XXXX and I have a home that is to be auctioned on XXXX/XXXX/16 by Fay Servicing. I am pleading your help to stop this auction NOW to allow more time to try to sell my home in order to avoid a foreclosure. Fay Servicing has filed a judicial foreclosure on me in order to foreclose on my once ( PAID OFF HOME ), and i am a victim of predatory lending.
I 'm a very ill, XXXX, XXXX XXXX XXXX XXXX. I have fought to keep my home I 've lived in for over 25 years from a present foreclosure. My home is at the point of a Sheriff 's sale now and hanging by a thread.
Originally XXXX held the mortgage starting approximately on XXXX. At some point later, XXXX XXXX XXXX bought XXXX and took over administering my loan and others. I might add that both banks held my feet to the fire by lies, threats, intimation. But worst of all-hollow deceitful promises to keep me at home from false promises of a re-modification on my existing loan which never happened. I paid XXXX full payments even after falling ill, and struggled to work with them by sending smaller payments every month. But instead of helping me they sold my mortgage to XXXX XXXX XXXX. I then paid them a years worth of preloan modification payments of {$420.00} because XXXX XXXX XXXX made deceitful promises of a loan modification just like XXXX did. I must add that every dime I paid XXXX of these banks came from my small social security check every month. Needless to say I had very little to live on left each month even though I had monthly utility bills, medical bills, etc.
However, during my ongoing deterioration of health, XXXX I continued to try to save my home by applying for various government and state agencies foreclosure help. All turned me down because I 'm too sick, too old and have no viable income other than social security! I 've tried to get a Quite Title, or a Life Estate solution with no results from the folks helping me in this capacity. No one seems to care if I lost my home!!
So I kept searching for help every where I could over the last nine years. However, drowning in useless paperwork, and intensive computer research, plus every other source I could find but to no good end, I became so ill that I lost all my XXXX. My whole life changed from my credit rating, normal life style, due to health driven emotional highs and lows XXXX ). I lost items I could not pay for, and stopped my phone service, cable and other non essentials I could not pay for. I was and am desperately ill and basically trying to survive alone against a tide of life crashing down on me.
Later when other mortgage companies tried calling me they could now reach me. Even so, when I received their mail and because of the shoddy and criminal way I was treated by XXXX, XXXX XXXX XXXX ; and so called Federal and State Foreclosure agencies, and mostly because of being so desperately ill, I did not always respond, or if I did, I demanded proof of their having a legitimate right to handle by mortgage, and promises of help, which none supplied.
My health issues can be confirmed by other documents, including doctors numbers, dates and other medical and Washington state services I have or am receiving now, if needed.

Complaint: The mortgage on the home that my ex-wife and children live in was finally modified under what I believe to be the XXXX Program. I say finally because we attempted either XXXX 4 times over multiple years to get a government sponsored modification from XXXX XXXX XXXX and ran into issues such as " lost paperwork '', incorrect information and possibly outright lies and mail not being received that was supposedly sent by them. The modification was eventually finalized on XXXX/XXXX/XXXX by XXXX XXXX XXXX. XXXX days later on XXXX/XXXX/XXXX, this mortgage note and the loan servicing rights were sold to Fay Servicing. The issue is that to this point Fay Servicing is not recognizing the fully completed and executed loan modification contract which is causing both my ex-wife and I significant problems. They have incorrectly reported false information to the various credit reporting agencies while they had the correct information available to them, thus causing XXXX loss of a significant opportunity as well as damage to XXXX my ex-wife and I in general. In response to our numerous requests to have them correctly recognize the completion of the loan modification as well as removing and/or reversing the false reports to the various credit agencies, they have refused to give specific dates when these issues will be addressed/completed, and have not provided answers to pertinent information relating to this account and these issues. All the while, they have continued to report false information regarding our credit, thus exacerbating the damage to us, as well as refusing to address the situation of incorrect miscellaneous charges being applied to the account due to their lack of recognition of a fully executed legal contract in the form of the loan modification. In the case of both XXXX XXXX XXXX and Fay Servicing, there are more specifics relating to these issues and the lack of responsiveness in addressing them appropriately. However, I think that this correspondence should provide enough information to your tax payer funded, consumer oriented regulatory agency to get the ball rolling in not only an effort to provide relief to my family, but to point out some of the outright abuses and possibly fraudulent actions of these financial service companies that have been enjoying some well documented, tax payer funded protection over many years. I will be very willing to respond in any appropriate way regarding this and related matters, and add my voice to the issues in order to attempt to reign in the abusive nature of these companies and the financial services industry in general. They are doing untold amounts of damage to the general population of our country while receiving tax payer funded protection from the very elected officials and civil servants who are supposed to protect us, their constituents, and whose salaries and benefits are being paid for by those very same taxpayers.
