Complaint: I have learned that Faye Servicing is the new loan Servicer.. Initially, XXXX XXXX owned the note, then XXXX, then XXXX XXXX.XXXX XXXX. I also learned a new group, XXXX XXXX, purchased the loan. Faye Servicing had been sending time sensitive and financially sensitive mortgage related documents to the main building address of where my I live, and not to my personal residence. This means that the property manager or someone else has been receiving very sensitive financial information regarding my loan. This action was intentional.
In XX/XX/2018, I sent a Validation of Debt request to Fay Servicing. I including my mailing address, which the previous note holder, XXXX XXXX, used and is in public record. I also included my condo unit number.physical address in my Validation of Debt request.
On XXXX XXXX, I received a written response from Faye Servicing which was dated XX/XX/2018. Faye 's response refers to my physical address as the main building address ( there are approximately 250 units in the building ). The " Prior Servicer Account History '' which Faye sent me only includes the XXXX XXXX payment history that is illegible and impossible to authenticate. The font is exceedingly tiny, and I can only identify the " XXXX XXXX '' emblem '' on the paper. Fay Servicing failed to provide the payment history for the years when XXXX XXXX and XXXX owned the note. They failed to remove negative amortization debt that has been added to the loan balance, or address other charges and fees that have been assigned to this loan balance.
In summary, Fay Servicing has denied my request for a validation of debt and supporting documentation. They sent me a one page letter, which reads in part, " Please be advised that Fay will not provide any information or documentation considered confidential or proprietary, or that is not in our possession. '' Presumably, Fay Servicing has mailed mortgage and other pre-foreclosure related documentation, including my mortgage account number, to the general building address and not to my personal residence. Private mortgage financial documents, including the account number, have been directed to the onsite Property Manager and/or Homeowners Association. I believe these were acts of Willful Negligence. The " General Building Address '' repeatedly appears on the Fay Servicing documents, including when referencing my account number.
Consumer Law requires a debt collector to validate the debt ; Fay Servicing is dismissing themselves of this requirement by stating they " do not have certain documents in their possession ''.
A " Fair Debt Collection Practices Act Validation Notice '' dated XX/XX/2018, which was included in Fay Servicing response to me, includes line items such as Current Unpaid Escrow Balance : {$0.00}. Current Unpaid Accrued Interest : {$0.00} Partial Payment not yet Applied : {$0.00}. Late Charges : {$0.00}. Fay Servicing and XXXX fail to state the total amount due.

Complaint: Our mortgage is through XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX, d/b/a/ XXXX XXXX as Trustee and our servicer is Fay Servicing. We had a loss of income hardship so I applied for a modification. On the application we had checked the box that said we wanted to keep the home. They gave us options were we would have to give up the house so we turned the offerings down. They started the foreclosure process because we could not make the payments. In the meantime, I had become XXXX and was waiting on the back pay to bring our mortgage current. I kept applying for modifications and we kept getting the offerings where we would have to move. I had checked into government plans and we did not qualify for any of them. I also applied for HEMAP and we could not do that because we could not afford to start paying immediately. Finally one modification they offered a lower interest rate and added the balance of the money we owed on the back of the loan but it was to be paid all at once. We could not afford that last end payment so we applied for another modification looking for something we could afford. It turns out that we did not understand that we would be able to refinance through another lender when that large payment came due. I contacted them to see if we could accept that offering since we did not understand it and they told us no. Since we rejected it, they could not offer it again because the rejection meant that we could not afford it. I applied over and over and kept getting offers where we would not be able to keep the home. My back pay from XXXX finally came in and we were able to bring the loan current. However, even with XXXX payments, it is still a hardship for us to make the loan payments. I applied again and they sent me a letter saying that we were not eligible for any alternative to foreclosure and do not quality for any available loss mitigation options. It just indicated that we would have to reinstate the account which had already been done. I am just asking for a lower interest rate now that we are paid up and they don't seem to want to help. Also, they are sending statements with " fee charges '' but no where does it say what it is for. It just throws a dollar amount in there. Our escrow amount keeps going up also even though our taxes have barely changed. I called the tax assessor to confirm and which she did.

Complaint: I received a letter dated XX/XX/XXXX that Fay Servicing LLC will continue all arrangements with my existing forbearance plan. Effective XX/XX/XXXX the servicing of your mortgage loan is being transferred from XXXX XXXX XXXX XXXX ( XXXX ) to Fay Servicing , LLC. This means that after this date, Fay Servicing LLC will be collecting your mortgage loan payments from you. Nothing else about your mortgage loan will change. It goes onto state : Loss Mitigation in process ( e.g. trial or permanent modifications forbearance plans or short sale/deed-in-lieu agreements ) with XXXX will be transferred to and will continue with your new servicer. You may contact either XXXX or Fay Servicing , LLC to determine the status of a loss mitigation application that remains pending at the time of transfer. Fay Servicing , LLC may require new supporting documentation from you to be considered for a pending application.
During my loan forbearance period of XXXX, XXXX and XXXX of XXXX I have made my payments as required in the amount of : {$380.00}. As previously submitted my bank statements show payments posted to my bank account on : XX/XX/XXXX to XXXX for {$380.00}, XX/XX/XXXX for {$380.00} and XX/XX/XXXX for {$380.00} to Fay Servicing. I attempted to make my next regular payments in the amount of {$630.00} for the next 2 months and was told to hold off per XXXX XXXX at Fay Servicing, as I was required to complete another packet of borrower assistance paperwork that was emailed to Fay Servicing on XX/XX/XXXX. After speaking to XXXX regarding my tenant XXXX XXXX giving me cash payments for her bi-weekly rent, I was told resend page 2 of the assistance paperwork removing the {$500.00} in rent received and only use my income. As for not being able to show how the cash payments were being used as I had not deposited them into my bank account, however used the money to pay for my local expenses ( cable, water, sewer and groceries with this money. ) However, was told by XXXX to not adjust my page 3 paperwork for the monthly household expenses and debt payments which would have showed me as being over extended without being able to use the {$500.00} in monthly rent. This paperwork was sent to Fay Servicing via email on XX/XX/XXXX. Then on XX/XX/XXXX I had to send additional documentation regarding a settlement I received from a prior employer.
On XX/XX/XXXX I received another letter from Fay Servicing dated XX/XX/XXXX with an Appendix A stating I was unable to be approved for any loan modification programs due to my income, and my only option was a short sale. I called several times requesting to speak to a manager regarding my account and was told that a manager was not available, and unable to review my account. However, if I wanted to appeal my case I am to send my request via US mail by XX/XX/XXXX and a manager would review.
I was able to appeal my first set of paperwork as my son moved back with me however I went through an appeal again on XX/XX/XXXX sending revised borrow assistance form. I was contacted again on XX/XX/XXXX from Fay Servicing to get my son 's tax returns, which was emailed to them. Then I contact Fay Servicing on XX/XX/XXXX for follow-up on my loan modification as we were getting to the end of the 30 day window only to find out my mortgage was sent to another servicer and I potentially have to wait another week to 90 days for the paperwork to be evaluated. This is unfair as I have been trying to make my payments, and sending paperwork six times ( 2x-USPS, and 4 times via email to Fay Servicing ) and I still do not have answer if I will be approved for loan modification.

Complaint: My Mortgage was original with XXXX, XXXX and XXXX, Then bought out by XXXX XXXX XXXX. I received notices stating my payments hadn't been processed to my account. Next thing I start getting calls from XXXX XXXX XXXX, I tried to submit all my documents to them for help on resolving this matter, Then Fay servicing was calling, neither time was I notified of the switch. I sent XXXX, XXXX XXXX and Fay servicing all information canceled checks and 2 different statements from XXXX with different balance numbers, I also informed them the XXXX XXXX XXXX had walked off and abandoned the property and sent them a abandonment affidavit. I was laid off and struggled with each of these after faxing multiple times loan modification application and not getting any response on this account. I have tried to get them to help me save my home, Fay services stated there was nothing they could do to help me. Not even giving me chance or explanation. This is my home stead property, I am eager to save my home and a chance to do it. Complaint: Fay Servicing LLC is attempting to seize/sell my Home at XXXX XXXX XXXX, XXXX, MA XXXX despite that we are in modification process to allow us to keep our home. We have a child who is XXXX, and we want to do every legally possible to keep him in this home where he was born and provide stability for him.
In XX/XX/2018, Fay Servicing LLC through its Account Manager XXXX XXXX offered us a trial payment of {$1900.00} under Fay Servicing Modification Program.
We quickly notified them that we could not afford this modification. We reapply for the modification, and in XX/XX/2018, we were asked for documents that we provided in the past and were told, they wanted different type ; which were submitted just a month before. For example, we provided XXXX XXXX XXXX Binder, it was accepted several times without objection, and were told they need the policy.
We submitted everything and a new offer of {$1500.00} trial payment under Fay Modification Program. We were very happy that we finally got a monthly payment that we can afford. The payment was due XX/XX/2018. We made the payment online using Fay Servicing Website and not all the payment was taken. The website only allowed {$1300.00} to be paid. We sent the difference using XXXX through XXXX XXXX. Everything happened timely as requested. In fact, Fay Servicing us until the end of the month of XXXX to make that first payment to be able to accept the trial payment offer. In the middle of XXXX, the time for Fay Servicing LLC to accept the payment of {$240.00} made through XXXX XXXX expired online.
We requested that they make an option available to received the difference, we were told that could not be done. As such, we tried another payment of what is allowed online. Another payment of {$1300.00} was processed XX/XX/2018 and applied through Fay Servicing LLC 's website which would now cover the full payment for XX/XX/2018 with the difference to be applied toward XX/XX/2018 's XX/XX/XXXXpayment. Two separate checks made online were sent for {$240.00} mailed to Fay Servicing LLC from XXXX. To our surprise, on the eve ofXX/XX/XXXX, we were served with Foreclosure sale notice sent by certified mail and first class dated signed by a foreclosure specialist from Fay Servicing LLC on XX/XX/2018. Not even 30 day notice, and a notice that came while we were working to enter a permanent modification.
It seems that Fay Servicing LLC has no intention to modify the loan and is playing tricks to come and get our home.
We want Fay Servicing LLC to make good on this promise to a permanent modification that we have already accepted by making trial payments. I am not sure what is going on, but this is plainly malicious.

Complaint: Fay servicing XXXX XXXX has not made my payments via escrow acct to insurance company all while I was under the impression that they had this escrow acct and were doing so! They also have misapplied payments in an effort to foreclose upon my home! I requested to get my home reappraised since the value has greatly risen they denied this giving me incorrect information and immediately sent a person to my home onXXXX and or XX/XX/18 this was done after I got insurance on my own yet they still hold funds in escrow on the account I have asked for escrow funds to be returned to be due to their failure to pay home insurance! I have had head injury, many surgeries and have been laid off from my job recently!

Complaint: I spoke with Fay Servicing on XX/XX/XXXX requesting a billing statement which reflects the amount due in order to bring my account current. My account manager- XXXX advised that she could resend a demand letter that was sent previously. I provided her my email address and re-authorized email communication as it was done previously. In the interim, she provided me with a payment amount of {$2700.00} needed to bring my account within 30 days past due. She also suggested loss mitigation as I fell behind on my payment due to a car accident. I explained to her that the amount was being paid by a settlement/modification wasnt needed. I sent a payment of {$2800.00} on XX/XX/XXXX. I begin to make monthly payments the following month with no further communication from Fay. On XX/XX/XXXX ; I received a letter explaining that my XXXX payment of {$980.00} was not accepted as my account is in pre/ or active foreclosure. The check payment was returned uncashed to me. I immediately emailed my account manager for clarification on why the payment was returned. My account manager called on XX/XX/XXXX-unaware of the email sent or returned payment ; requesting an update on the loss mitigation documents. I explained the issue/she located the email sent while we were on the line. Upon further research ; she explained that the {$2800.00} payment was misapplied to another lien account. She explained that she would reach out to her manager to have the payment applied to the correct account XXXX ; collections activities would cease and I can make payments going forward. On XX/XX/XXXX ; I received a {$2800.00} refund check from Fay Servicing. I called in on XX/XX/XXXX and was advised that there was a request to refund the misapplied payment vs apply to the correct account/that the account is still in active foreclosure. Please assist with getting a reinstatement amount/ additional processing fees waived. This is the 2nd issue that Ive had with misapplied payments.

Complaint: On XX/XX/2018 Fayservicing served me a summons and I had 30 days to respond. I took off work and went to the court house to respond to the summons only to find out there was not record of me being summons. I received an email to come to court regarding my property I took another day off work and went to court only to find out I was not on the docket to come to court. I spoke to my account Representative XXXX XXXX mid XX/XX/2018 he asked me what did I want to do with the property I told him I wanted to do a modification he told me I didn't qualify for a modification I need to sale the property because I had equity and Fayservicing would not work with me. I told him I tried to sale the property and didn't get a buy so I was going to rent it out. I told him I have a potential renter that will move in XX/XX/2018 and I would apply try again to apply for a modification. My rented moved in and I submitted the modification application and a copy of the lease. I received a letter requesting more information and was told I have until XX/XX/2018 to submit the additional information. I find out on XX/XX/2018 Fayservicing is harassing my tenants going to the house asking them who really owns the house and they have a letter for me from the mortgage company. Fayservicing knows exactly where I live and could have sent or brought that letter directly to my house. Im really starting to feel harassed and frighten. What else will they do besides harass me and my tenants. I was told by a consumer counsel they are predatory lenders. Can you please help. The additional person is my tenant.

Complaint: Fay Servicing has continued to ignore my written and verbal requests for my mother 's XXXX impound refund. This should have been returned when I brought her loan current when she passed away. I am the executor. The loan was brought current in XXXX I believe and was paid off XX/XX/2018. The title company gave them the forwarding address for the check and I personally called them. The person on the phone said he was sending it to XXXX XXXX. I explained that they had paperwork from a year ago that says my mother does not employ them. They assured me I would be sent the check. Its been over a month and I have called many times they said they sent the check to XXXX XXXX. XXXX XXXX who is a legal firm says they do not have it. Fay Servicing is once again withholding money which is due my mother 's estate. There is also a XXXX amount that was on the payoff statement that said refundable and they will not give me any explanation. This lender feels like they can ignore individuals and they answer you with some random untruth and its settled. I go to court with them in XXXX over the 26k, but want the impound account back of XXXX.

Complaint: XXXX XXXX XX/XX/18 Loan # XXXX XXXX XXXX XXXX XXXX Ca XXXX I would like to file a complaint on my mortgage Servicer FayServicing after being over two months delinquent on my mortgage loan I contacted my mortgage company Fay Servicing and spoke to my account manager XXXX XXXX, i explained my hardship situation to her, she told me the fact that I already had two modifications in 15 years I will not be eligible for any loss mitigation options, she stated the Deed-in-Lieu of foreclosure is more likely my only option, I refuse that option and ask her for a Loss Mitigation Application, after completing and return the mitigation application, I make it my duty to call my mortgage service Fay Servicing every few days speaking to different representatives asking for updates on the decision letter of my Application, as in when was it mailed, how long does it take, knowing time is of the essence, I finally receive the decision letter on XX/XX/18 I decided to appeal the Deed-in-Lieu offer, I imedeatley contacted Fay Servicing explaining the decision letter dated XX/XX/2018 and I just received it XX/XX/18 the representative advised me to still go ahead and email my appeal to my account manager XXXX XXXX at XXXX she also provide me with the appeal department email XXXX I emediatley send my appeal to both XXXX XXXX & appeals department, I also include in my appeal the date I received the letter, I called my account manager on that following Monday for an update on my appeal, she told me the fact that I received the letter after the fourteen days window my appeal will not be considered, I was upset telling her thats not fair treatment, if they didnt send the letter in a timely manner I shouldnt be denied to an appeal, I ask to speak to her supervisor XXXX who didnt provide me with a last name explaining the situation and asking her to investigate all my recorded calls regarding the decision letter, she was not helpful at all she told me its no need to appeal because the decision will be the same, I told her I dont care just dont take away my opinion to appeal, at the end of our conversation she told me she will investigate and let me know what she can do, Im not comfortable after our conversation, I dont believe its in her interest to investigate the situation for me to appeal.

Complaint: Fay Servicing has increased our Escrow by using figures that DO NOT include all of our mortgage payments. They purchased our loan in XX/XX/2018. XX/XX/XXXX and XX/XX/XXXX payments were mailed separately to them. However, on their report sent to us by a their Attorney that they sent to Court only show one ( 1 ) payment being made not two. I have attempted to send them the cancelled checks but XXXX XXXX refuses to accept them and get this resolved right away. This has also caused lots of unnecessary stress on us and loan companies calling us saying our loan has been MARKED for inclusion trying to get us to refinance all due to them not posting all of our payments. This is a Federal Violation of our rights, not applying our payments, misreporting our mortgage account to Credit Bureaus for months now, and deceptive by omitting these important facts to increase our Escrow.They have a letter from our Attorney to talk to us on file.

Complaint: Back in XX/XX/XXXX/XXXX of 2017, I made my mortgage payment thru XXXX thru a wire transfer. Fay Servicing contacted me on the last day of the month and stated I had to made by mortgage payment. I immediately gave permission to make a payment at that time. The next day was the XXXX of the month, and upon checking my account, I noticed that Fay Servicing had already been paid the previous month on the XX/XX/XXXX. I immediately stopped the telephone payment and contacted Fay Servicing to find out why the rep had lied and told me I was late on a payment, that had already been paid. Since that time, my rep has changed 4 times, and no one seems to be able to help me. Currently, I have 3 late payments this year, and once I realized the discrepancy I immediately attempted to have an investigation done, to no avail. The conversations are recorded and I have all of my transactions documents. In the meantime, the payments are current.

Complaint: I have employed the service of a foreclosure defense attorney who has been helping me navigate the short sale process. My attorney has maintained constant contact with my lender, Fay Servicing. However, the lender failed to notify my attorney or her staff that the lender scheduled a sale date for my property. During the short sale process, my attorney was assigned to a single point of contact XXXX XXXX, who failed to make a good faith effort to disclose all pertinent information related to my account or account status my attorney contacted Fay Servicing beginning on XX/XX/18 to the current date. On multiple occasions my attorney called XXXX XXXX, my single point of contact and asked if there were any new notes added to my short sale file or my account. On multiple occasions, my attorney asked Fay Servicing if there were any changes to my account status and XXXX XXXX failed to disclose that the lender scheduled a foreclosure sale date on my property while simultaneously falsely communicating with my attorney that there were earnestly reviewing my account for a short sale. It amounts to dual tracking and is illegal. A lender assumes the role and responsibility to disclose ALL information related to the status of a borrower 's account. They failed to disclose information to my attorney who contacted my lender on a weekly a basis. My attorney asked XXXX XXXX on XX/XX/2018, XX/XX/2018 and XX/XX/2018. XXXX XXXX lied to my attorney and said that there was no foreclosure sale date on my property. On, XX/XX/2018, my attorney spoke to XXXX XXXX 's manager, XXXX XXXX and he said that he didn't know why XXXX XXXX would have lied or provided false information about my account status. After pressing XXXX XXXX for a full and truthful disclosure, did he admit that the lender scheduled a sale date for my property on XX/XX/2018. Fay Servicing engaged in inequitable and fraudulent conduct when servicing my loan. As a fiduciary, Fay Servicing failed in it's implied duty of good faith. Furthermore, Fay Servicing stands to benefit from misrepresentations that XXXX XXXX and XXXX XXXX made to me. Fay Servicing is liable for constructive fraud. The lender has a duty to disclose all information related to servicing my loan and repeatedly failed to do so. I employed a foreclosure defense attorney to communicate directly with Fay Servicing.
