Complaint: On XXXX / XXXX /17 a payment was made through my bank account for my mortgage payment to Ditech Financial LLC to an accidental incorrect account number. ( XXXX ) A month later I get a letter in the mail saying the payment was never made because I had accidentally typed the wrong account number in payment information. I called Ditech Financial immediately and made two months payments on XXXX / XXXX /17 to make the account even and Ditech said they would do a research to find funds and apply it to the account. That has never happened. I have filed at least four disputes to get the money back and they keep saying they can not locate the money even though my bank has faxed Ditech the Federal Trace information numerous times to show with 100 % certainty the money was sent and they have the money. I had the bank three way call Ditech with me to verify that funds were sent and they never came back to my account because of a bounced back payment from Ditech. Since Ditech can not find the money in their system they keep denying the dispute. I understand I made a mistake with typing the wrong account number but Ditech Financial for sure received the payment in their account and refuse to make right of my overpayment for my mortgage.

Complaint: I am very disappointed of Ditech I submitted all my documents since XXXX /2017 . For a Deed in Lieu. since my intentions are to return the home to Ditech. I can not afford it, I am doing what is best for me and my health I am XXXX XXXX XXXX and is getting harder for me to move around do to my XXXX . Therefore I was hoping to get some respond within 30 days and still nothing. We are almost going to end the month of XXXX and I am scare that I am not aware of what is going on. Every time I call Ditech for an update, some Agent tell me is under review and some tell me my file is not activated. I am starting to believe that Ditech intentions are just to foreclose my home instead of assisting me with my Deed in Lieu request. Please help me get a responds from Ditech it seems that they are purposely prolonging my case. I want know how much long I have to stay in my home, since is hard for my to move around I need to know with a head of time so I can have my family and friends help me move out. However I will not leave until I received my Deed in Lieu documentation.

Complaint: I received my billing statement on Saturday, XXXX XXXX , 2017. The billing statement shows XXXX / XXXX /2017 as the Statement Date. The XXXX / XXXX /2017 Statement Date implies that this bill took 14-15 days for delivery to me. For this reason I do not believe that the XXXX / XXXX /2017 date approximates the date when the bill was presented to the US Postal Service for delivery to me. My expectation is for the Statement Date to b e the date when the Statement was prepared. I have brought this problem to the attention of th e Green Tree ( DiTec h ) organization on previous occasions ; their assertions as to bill processing are unsubstantiated and therefore are viewed as unresponsive. XXXX Recent XXXX notices indicate that XXXX XXXX XXXX is approaching a time when the shares will no longer meet the XXXX listing requirements. XXXX XXXX XXXX also has proven itself unable to submit Financial Reports free of material error. XXXX XXXX XXXX appears to be in breach of its loan covenants. To date there has been no advice from XXXX XXXX XXXX as to what the debtor responsibilities may be if/when XXXX XXXX XXXX goes into liquidation or becomes unable to perform the servicing business.

Complaint: I was working with Ditech for a loan modification and unfortunately, i was denied on XXXX / XXXX /17 due to them miscalculating my income. I received a denial letter stating that I had a 30 day right to an appeal and i would need to submit documents to support the information. I faxed them all updated documents including income documents to support that they had made an error in calculating my income on XXXX / XXXX /17. Today, XXXX / XXXX /17 when i called in i spoke with XXXX who confirmed the documents were received and they were being set up for review. He then continued to explain how unfortunately the sale date would not be postponed because they needed to have the documents 37 days prior to a foreclosure sale date. This completely removes my right to an appeal because i was not informed of the foreclosure sale date until XXXX /20/17. I believe this would apply to someone who was not actively in review but i was and followed their instuction. I am now being told i may lose my home because of it. Please help me.

Complaint: I contacted Ditech Financial to set up payments for every 2 weeks so that I could pay my loan off earlier and save come interest. I was told that I could change my loan from a variable rate to 3.5. I then sent in all the information and was told that the title was not in my name. Funny, the tax bills come in my name. Here 's his email XXXX XXXX , The title company just verified that you are not the owner of this house. The title is in the names of XXXX and XXXX XXXX . You can not refinance this property with them on the loan. I can add XXXX and XXXX do the loan if you like and add your name to the title. Please let me know how to proceed. Complaint: Whenever I pay extra towards principal they seem to apply it to the future month, effectively doubling my interest. This has happened several times this year. On XX/XX/XXXX at XXXX CT, Ditech 's Customer Rep XXXX, enrolled me in their program to automatically apply any payment that does not match my Regular Monthly Payment to principal. <P/> On the latest occurrence, I paid {$5000.00} towards principal on XXXX and my Regular Monthly Payment on XXXX. They deducted over {$900.00} interest from both payments, so now my Principal balance is overstated by {$960.00}. My XXXX payment is due to hit today, so that will just compound the imbalance. <P/> On XX/XX/XXXX at XXXX I spoke to XXXX who understood and calculated the same Principal Balance as me ( {$170000.00} ) and said it would be corrected. I called XXXX on XX/XX/XXXX at XXXX and XXXX onXX/XX/XXXX at XXXX because my online balance still has not been corrected. All they do is say that they will submit my call. <P/> This company is very unresponsive, not very intelligent and I 'm sure that what they 're doing is illegal.

Complaint: Ditech set me up on a bi weekly payment plan to help me pay off my loan sooner. I have now found out that they were not applying the first half of my payment until the second half arrived. Thus they were sitting on my payment while my loan was accruing interest. I was lied to about the benifits of the loan an ripped off by this company. Even on my statements it shows amount paid as half but they informed me that is what I paid not what was applied to the loan. This is embezement and I want my money that I am owed. Complaint: I had two mortgages in XXXX so I called XXXX to modify my primary residence. They informed I could not modify my loan because I was current in my payments. XXXX said I could apply after I was at least three months behind in my payments. I waited three months then called to apply for a modification. In the interim I received a bill for the full amount of the loan and a foreclosure notice. My modification was denied by XXXX. Both my loans were sold to XXXX XXXX XXXX ( I still owned the other house since it could not be sold ). On XX/XX/XXXX I retained XXXX XXXXXXXX XXXX to represent me in my modification efforts. I was again denied and during a conference call with a XXXX XXXX XXXX representative, XXXX XXXX and myself, a reason could not be given for the denial. XXXX XXXX stated she did not understand what was happening, then said she could do nothing further to assist me in my modification efforts. OnXX/XX/XXXXI contracted with XXXX XXXX XXXX They were hopeful a modification would be possible on my primary residence.Again after several attempts, my modifications were denied and XXXX XXXX fell by the wayside. On XX/XX/XXXX, I spoke to XXXX at XXXX XXXX XXXX. XXXX finally shed light on the problem. Apparently, my records indicated I defaulted on a previous modification offer. I informed XXXX I was never offered a modification and asked to see the paperwork/proof of delivery. XXXX could offer neither. My modification applications continued to be denied. In XXXX. I unfortunately became the victim of a mortgage fraud scheme by XXXX XXXX formally XXXX XXXX. They claimed to have contracted to negotiate modifications on a block of mortgages from XXXX XXXX XXXX. XXXX XXXX, on behalf of XXXX, claimed to be an agent or XXXX XXXX XXXX. He claimed I was approved for a modification and my trial payments were to be sent to XXXX. I was contacted by the State of New Jersey Consumer Agency advising me of the scam that had been perpetrated by XXXX. My heart sank. I had made four payments of {$2700.00} to XXXX XXXX at XXXX ( bank statements to follow ). On XX/XX/XXXX, I contacted XXXX XXXX at XXXX XXXX since I have an FHA loan. I lodged a complaint against XXXX XXXX XXXX and asked XXXX XXXX if his agency could make a decision regarding my modification application, since they were the investor. XXXX XXXX advised me the mortgage servicer make all the decisions. I continued applying for modifications, about one per year. Each application required submission of all documents usually anywhere from 50 to 75 pages. My modifications were denied because they claimed I did not send a XXXX bill even though, I had the manager of that department on the phone verifying the bill had been sent. I have and entire file cabinet drawer full of rejected modification applications. In XX/XX/XXXX, I was offered a modification per the lender, Greentree at 4.5 % under the " know your options '' program by XXXX XXXX I made the three payments of {$3500.00} as agreed. I was hopeful the regular payments would be lower since these payments were a challenge to make. My new mortgage amount was {$3200.00} per the permanent modification package. XXXX XXXX from Greentree said all the late fees were waived, and the mortgage would be decreased to 2 % if I made all the payments on time. I signed the permanent modification on XXXX XXXX, and sent in my payment of {$3200.00}. I received a call from XXXX, my representative at Greentree about six days after I submitted the payment. XXXX advised me I made an underpayment. I advised XXXX I paid the agreed amount stated on the permanent modification. XXXX advised me the correct amount was {$3500.00}. A letter dated XX/XX/XXXX advised me my payment was in a suspension account and would not be accepted by Greentree. I felt outraged by what I considered dishonest and unethical behavior on the part of Greentree. I felt they tricked me into signing the permanent modification only to reject my first payment. I hired XXXX XXXX XXXX to help me with Greentree. In the interim, my loan was sold to Ditech. I was offered a HAMP modification package in XXXX XXXX. The payments were $ XXXX/month. My first payment was made over the phone for XXXX XXXX without a hitch. In XXXX, I received a letter stating that effective XX/XX/XXXX DiTech would be closed for business for two weeks while the performed a system upgrade. I called, my second payment in on XX/XX/XXXXXX/XX/XXXX for payment on XXXX XXXX For whatever reason, DiTech removed my funds on XXXX XXXX. I was received an overdraft notice by XXXX a day later. I spent XXXX XXXX on the phone and sending emails to Ditech of the error. They did not take the funds out in XXXX despite the fact I emailed them my bank statement showing the funds were available on XXXX XXXX. I had not transferred the monies from my business account to XXXX until XXXX XXXX. The monies remained in my account the entire month despite my calls to Ditech requesting the monies be debited. On XXXX XXXX, I noticed XXXX XXXX payment was not debited despite a confirmation number and agreed debit date. I called Ditech. and XXXX and XXXX were debited at the same time. I did not hear anything about a permanent modification, and made XXXX and XXXX payments on the advice of XXXX XXXX at XXXX XXXX XXXX XXXX. In XXXX I advised her I would not make anymore payments to be placed in suspension accounts. DiTech did not indicate a permanent modification was imminent. I contacted XXXX XXXX again and placed a complaint with XXXX. I felt that Ditech 's behavior was unprofessional and probably in violation of the Dodd-Frank Bill. XXXX told me not to sign a permanent modification until she finished her investigation. In the interim, I made two more payments. They offered me a permanent modification but they changed the terms and interest rate of the temporary modification. I sent XXXX emails asking for advice, and she told me not to sign the permanent until she finished her investigation. I was told by Ditech that the offer would expire, so I advised XXXX from XXXX XXXX I could wait no longer for her to finish her investigation, and signed the permanent modification in XXXX. I did not make a payment right away like the last time, because I was waiting to see if they would increase the mortgage amount, which they did. On XX/XX/XXXX I received a letter increasing my payment to {$3100.00}. I do not understand why since, my taxes were reduced from over {$10000.00} to about {$8400.00} and my insurance policy went from almost $ 3,000/yr to {$650.00}. I called XXXX at XXXX XXXX XXXXXXXX XXXX. and she said it was a computer generated letter and I should ignore it. XXXX said that XXXX XXXX, myt Ditech account representative said my account was in good standing. Ditech said my XXXX payment was made, so I thought they used the funds they had in suspension. I made XXXX XXXX payment In XXXX. After my payment cleared the bank, I went online and pulled up my account. I noticed the bank had rejected my XXXX payment and placed it into a suspension account. I sent DiTech a certified letter requesting to DiTech an update, and they said they would investigate. That was at the end of XXXX, and I am still waiting

Complaint: I have perfect credit history and have never been default on any bills, mortgage or credit card payments until Ditech ruined my credit by changing my monthly mortgage payment amount starting XXXX XXXX which caused my usual payment to be {$45.00} short in XXXX. Ditech then held my regular mortgage payment of {$1100.00} as unapplied fund and charge me late fees without proper notice me in time to prevent late payment. <P/>I made extra payment immediately after I realized the payment change in early XXXX. But I was still flooded with collection calls and foreclosure and homeowner assistance letters. <P/>I was treated with no respect in most phone calls even thought I explained the situation and the fact that Ditech failed to properly inform me about the payment change prior and after the usual payment were made in XXXX. I found other good paying customers have similar complaints online ( XXXX XXXX XXXX ). <P/>A supervisor at Ditech customer service even firmly deny my right of dispute and told me it is no use at all to file a dispute. I feel I have no options but to log this complain with CFPB. Please help to address this concerns.

Complaint: WE paid the Loan off according to banking standards and sent three money orders in the amounts of what we owed at the time. These are the amounts XXXX , XXXX , XXXX . Where did this money go? The bank reps told us they would not accept, cashiers checks, money orders or cash.So we were told to send them via a credit account all money orders to Dept of Treasury in California who deals with XXXX XXXX XXXX . We believe they lied and forced us into foreclosure. We also got a document from the bank in XXXX saying all mortgages were paid off from the county recorders office which i followed up with when I got it as I used to work there and was a notary for many banks as well.. All mortgages were off the books six moths later in XXXX they appear now under Green Tree .We feel that many people involved committed fraud. The banks and their affiliates including the recorders office of The county . Which I still have. Talked to a rep on the phone a few days ago and they admitted the debt was paid as agreed I have that phone conversation recorded as they recorded mine too.. Please help me clear this up, end this or at least meet at the table to come to a final conclusion. Also we tried several loan mods with XXXX and two short sales which both were rejected. Ditech will not allow us to pay our own property taxes or homeowners insurance as they do through escrow. I paid the taxes a few times throughout the years sneaking it it in.Have been paying my homeowners as well for more than two years.Still they are charging me for this too. I am also having different agencies look into this including my background which was with The state police for 25 years, MY friends are in The FBI, CIA, Pentagon and many other offices or branches of federal, state or local government including the Ag ' s office.The IRS as the fraud may cause many errors in what we do n't owe them.The bank may owe them even more as they are reporting something that was paid off as something as a discharge. The document I got is from XXXX XXXX The Vice president of XXXX at the time showed all mortgages were paid off at the time of XXXX also notarized by here back notary XXXX XXXX XXXX and sent to my county to record the mortgages as paid. To make matter worse we living a XXXX XXXX XXXX home all around us and we are trying to prevent others from getting sick I had a firm come out here remove some but there is so much around us .I could only afford so much to get removed. Please help in any way you can. <P/> This is now with Ditech a XXXX XXXX XXXX , as XXXX XXXX XXXX through them under the bus. <P/> XXXX denies all facts and has no standing or original documents supporting their inaction.They are implicit and so it Ditech. Subsequently, the loan was forgiven as part of the Mortgage Debt Forgiveness Program , reported to the credit bureaus as paid/charged off, and the lien was released. My research reveals that your loan ending in XXXX was paid through the XX/XX/XXXX installment and was not referred our foreclosure department prior to the service transfer. I have enclosed a loan history statement for your reference. On XX/XX/XXXX , w e transferred the servicing of the loan ending in XXXX to Green Tree Servicing LLC ( Green Tree ). We notified you of this change in the enclosed letter dated XX/XX/XXXX . The new servicer, Green Tree, now supports all the loan servicing for the loan account, including billing, payment processing and customer support. Please contact Green Tree at XXXX to discuss any loan servicing-related matters. Representatives are available Monday through Friday from XXXX XXXX to XXXX XXXX and Saturday from XXXX XXXX to XXXX XXXX XXXX . Our records shows that prior to the service transfer, your loan ending in XXXX was approved for a Trial Period Plan in the amount of {$1700.00}, effective XX/XX/XXXX . However, our records indicate that we did not receive the signed Intent to Accept Trial Offer form nor a trial payment in order to proceed with the home retention process. We mailed you additional notices informing you to contact XXXX XXXX XXXX to discuss alternative solutions to bring the account current. However, our records indicate that we did not receive a response with your financial information in order to review the loan for workout options. I have enclosed a copy of the above-mentioned notices for your reference. My research reveals that prior to the service transfer, we reviewed the loan ending in XXXX for short sale. However, the short sale reviews were declined as explained in the enclosed short sale declination letters. Our records do not reflect that XXXX XXXX XXXX received payments to satisfy your loan ending in XXXX in full nor any information to confirm your claim that XXXX XXXX XXXX informed you to send payments to the Department of Treasury in California. If you wish to pursue this matter further, please fax copies of money order receipts to XXXX and I will investigate the matter. Make sure your loan number is clearly displayed on all documents you send. Additionally, my research has uncovered no reasonable factual basis to substantiate your claims of fraud. Complaint: My payment history shows that Ditech had received a payment for {$1000.00} which was to be XX/XX/XXXX mortgage payment with the extra amount going to principal. They show the entire amount going to principal and that I have n't made a XX/XX/XXXX payment yet. I wrote them about this on XX/XX/XXXX and got a response on XX/XX/XXXX that reads : " Your request is being reviewed for appropriate processing, '' yet the account shows no mortgage payment for XXXX 2017, according to them. Given all of the problems with Ditech/Greentree that I 've had, I honestly believe this is an attempt by them to claim a late payment by me. I also wrote to them indicating that I was sending in XX/XX/XXXX payment early and that this, too, should be applied to XX/XX/XXXX mortgage payment. I have not seen that payment as posted, yet. I also asked ditech for a new security question from among the three they give me. The answers must be exact with cases correct and I ca n't remember one of the answers. I have been locked out of my account a few times because of this. Once is happenstance. Twice is coincidence. Three times is enemy action ... .XXXX XXXX . This is well beyond the third such issue with Ditech.
