Complaint: I have repeatedly received calls from agents from Credito Real USA to my job. Each time I have instructed these individuals to not call my place of business concerning personal matters. Despite my requests, these agents have continued to call.
On XX/XX/2019, a representative from XXXX XXXX XXXX XXXX actually came to my office to deliver a letter on behalf of Credito Real USA after XXXX on Friday, XX/XX/2019. The representative requested to take pictures of my vehicle in front of other suite owners in the building. That same day ( XX/XX/XXXX ) I sent an email to Credito Real USA instructing them not to contact my job. Today, XX/XX/2019, I received another call to my office number.

Complaint: So I bought a car from a used car dealership in XXXX called XXXX XXXX XXXX. I purchased a used ( XXXX ) miles when I purchased 2018 XXXX XXXX. It was sold to me at XXXX and had the pretense that it was new and not heavily damaged upon purchase. The entire loan process was extremely shady, the company, unable to get me a loan, ran my credit a total of 12 times ( without telling me that they were doing so ) until they finally found a finance company, Credito Real USA who decided to loan to me. At a whopping 24.95 interested rate that turned my originally XXXX financed into an astounding XXXX, they hassled me for documents for proof of residence even after I'd signed all the paper work and they'd agreed to lease to me and when I couldn't provide it ( I am currently in a between situations as far as living, I am a XXXX year old, XXXX American female who is a college student and not extremely financially literate, they decided to put a GPS in my car, turns out I ended up having to pay an extra XXXX to put it in my car which was not stated in the contract or they would take the car away, knowing I was in a desperate situation, I had to pay the money. A few months go by and the car turns out to have been in an accident, and has several major issues wrong with it that prevent it from being driven safely. I go to the dealership and the car requires over XXXX in repairs to run properly and that wouldn't even come with a gaurentee that it would continue to run well in the future. So having no other option because I don't have XXXX laying around, especially after I just purchased what was supposed to be a new vehicle, but to have the finance company come reposess the vehicle. This of course is going to completely tarnish my credit for 7 years, and now I am in a horrible situation because of unethical business practices along with predatory lending.

You can review my credit report and see that this account has never been delinquent. This loan had an origination date of XX/XX/2016 for a term of 66Months. 30 Payments have been made on this account in the amount of {$340.00} for a total of {$10000.00} the original principal balance was {$12000.00} the current principal is {$9500.00}. Lender changed names from XXXX XXXX and now provides loans to people with no XXXX.

Complaint: In short, AFS Acceptance financed a vehicle to me in XX/XX/XXXX. The vehicle was NEVER registered to me and I have not been able to use the vehicle though I made every payment on time, through XX/XX/XXXX. Beginning XX/XX/XXXX, I requested AFS to take action to obtain the registration and license plates I had paid for and subsequently been billed for. Months passed before AFS finally contacted me to inform me they had to " double pay '' to obtain the title and would be sending me the registration/tags. I NEVER received them. I tried to trade the vehicle in for another one in XX/XX/XXXX, I was informed this vehicle was titled in someone else 's name and had a different lien holder listed. In XX/XX/XXXX, AFS 's Title Manager admitted to me that AFS had NEVER obtained a title for the vehicle. I asked for the amount I had been billed upon the loan initiation ( for taxes, tags, documentation fees, and registration fees ) to be credited to my account from the date of initiation so that I would also be credited for the finance charge for said monies.
SHE REFUSED. She also informed me AFS had filed for a bonded title with the State of Texas in late XX/XX/XXXX. In XX/XX/XXXX, I filed a complaint against the auto dealership and then found out AFS had NEVER applied for any bonded title. I contacted an attorney at that time and was instructed NOT to pay anymore on this fraudulent loan. AFS was informed of my intent to sue and they were also instructed NOT to make any false or negative reports to the Credit Bureaus. I am providing documentation including emails from AFS representatives LIEING to me about having possession of the title, and correspondence from my attorney, XXXX XXXX. I can also provide a chronology of events with evidence I have to substantiate my claims. I do not want AFS to have access to those documents at this time as there is a lawsuit pending for Deceptive Trade Practices and Fraud.

Complaint: Last week, XX/XX/XXXX, i receive a phone call from MR XXXX, who keeps on calling me, my co workers, step mom. Both of which he called multiple times, when he already received my phone number from them. He called me, i chatted With him XX/XX/XXXX, he said he worked for AFS acceptance, i told him i couldnt make his payment at that time, he was very rude, asking for family members numbers and my wifes number to call her for a payment. I also said, do not call my work nor my family. He told me he got my privacy offline from the internet. Today, XX/XX/XXXX, he called me while i was working, and i cant Use my phone at work, he does NOT leave a voicemail, nor a message. He immidiatly calls my family member and co worker again stating he cant get ahold of me. He needs to stop calling me and my family and conworkers. Its getting out of hand. He needs to stop contacting me. How could someone so rude work for a company like that.

Complaint: I have an auto loan with AFS Acceptance and I am seriously concerned about the collections practices of the company and the treatment of their consumers. I will admit that I have experienced financial hardship for the last year and a half due to XXXX XXXX XXXX that has resulted in a loss and change of employment. I have recovered the vehicle after repossession twice ( XX/XX/XXXX and ( XX/XX/XXXX ), and have advised the company that I am working as diligently as possible to get back on track, although recovering a repossessed vehicle is very expensive and has placed me in more of a financial bind. As of today, I am now 31 dpd for XXXX and 1 dpd for XXXX, with a bal of XXXX. Due to my employers guidelines, I am not able to use my cell phone at work. I have verbally requested on multiple occasions that I would like for my cell number to be removed and that I can correspond via email, regular mail, or on my home phone. It should be documented that I have returned several emails, phone calls, and have advised when I could pay, following the company 's instruction to keep an open line of communication. After verbally requesting that my cell phone number be removed, this company continues contacting me multiple times per day, even after contact has been made with one of their representatives with my intent to pay. Multiple representatives advised me that they would remove my number, and I was even told on one phone call that they had to speak with upper management before my cell number could be removed. I was then advised that I would need to submit a written request for my cell number to be removed from my account. I sent a written request via email on XX/XX/XXXX and was told that my cell number was removed. From that day I have corresponded with the company via email and have returned calls when necessary. Today, XX/XX/XXXX at XXXX XXXX CST, I received a call on my cell from a representative named XXXX XXXX. I answered and simply asked why he was calling a cell number that I have not only verbally requested be removed but I have sent in a written request as advised. Instead of accepting ownership for the mistake, apologizing and disconnecting the call, XXXX began to antagonize me and stated that the account is my account and " whatever happens, happens ''. I calmly advised him that I understand that I am delinquent on my loan payments, but that there are guidelines that must be followed and I must still be treated with respect. I advised that I would be able to call him back to discuss the arrangements that were available. Upon calling back, I was transferred to a representative named XXXX XXXX that I have worked with in the past to recover my vehicle. May I add that when my vehicle was repossessed in the past I was well over 90 dpd with no payments made, and this is not the case. Today, XXXX said that there were no options available although I have advised that I would make another payment this month on XX/XX/XXXX. She states that there are no options available and that they will refer my account for repossession. I am now at a loss, I understand that there are collections practices that must be followed but I am truly trying to work with this company and am not receiving the assistance I need. I will admit that I have expressed my agitation with the harassing phone calls multiple times per day and that I have advised them that I know that there are guidelines that they must follow, I feel that this is why I am not able to get assistance and am now being forwarded for repossession once again.

Complaint: We started a deferment process on a car loan on XX/XX/XXXX. We have never been late on this loan or asked for this. The form was sent to us on XX/XX/XXXX by XXXXXXXXXXXX who is a manager. The form was completed immediately through their XXXX signature process and sent back on XX/XX/XXXX. We called on XX/XX/XXXX to ensure that all was received. The cs rep said yes. We continued to receive calls about our payment even though we were told by the above manager and CS representatives that our payment was deferred for XX/XX/XXXX and not to worry. The calls continue to come. We called on XX/XX/XXXX again being told deferrment was in process but to call at end of month reassured once again not to worry. We were told that we did not have a payment due until XX/XX/XXXX. We called on XX/XX/XXXX asking for payment alarm to be turned off. It was turned off. Today XX/XX/XXXX we received a nasty call that we needed to contact AFS Acceptance about our account ASAP. We called and were told we owe the XX/XX/XXXX payment and that now it was going on our credit as late. We have had this car since XX/XX/XXXX and have paid its enormous interest payment every month on time. It is a 60 month loan at high interest due to be paid off next year in XX/XX/XXXX. These guys are very unprofessional and horrible with how they treat customers. The car dealer who sold us the car went out of business two months after putting us in this awful loan. We have followed everything they asked and they have continually lied to us. Our credit should not have anything negative at all since they messed a simple task up. Complaint: I surrendered a vehicle in XXXX of 2015. My balance was around {$12000.00}, and they sold the vehicle for just under {$5000.00}. With fees and interest, my account charged off and reported to my credit as me oweing a little over {$7900.00}. I decided to call them and see if I could pay a settlement amount to have the account satisfied. The customer service rep I spoke to, after over 15 minutes and several reps that could not find or assist me on my account, was very rude and kept telling me very incorrect information. She tried to tell me that my balance was actually over {$10000.00} due to the fact that the amount charged off, did not include any of my per dium interest accumulated during the life of my loan. I 've worked in the subprime lending industry and I know how simple interest loans work. But she tried to tell me that THEIR company charges the interest at the end of the loan, even though my contract did not state this AND my payment history did not reflect this. She tried to tell me that she would be willing to take off the {$2500.00} from the {$10000.00} she said I owed. This is an incorrect amount by my payment history, as well as the agreed upon terms in my contract. She was attempting to collect on a higher amount then what I owe amd lied to me on how their simple interest loans work. She refused to get me to a superior, stating she was the boss and there was no one above her.
