Complaint: XXXX XXXX XXXX sent a bill to Capio Partners stating I owed and never paid my hospital bill in the amount of {$190.00}, I never received a bill from the hospital. Then Capio Partners put on my credit XX/XX/2018 that I owe them this debt. I never new I owed a bill with the hospital because I have two insurances ( XXXX & XXXX ). I called XXXX and was told the bill statement was sent back saying invalid address, this is why I never received a bill, this was a clerical error on XXXX billing. This bill is paid and Capio Partners have yet to remove this negative action of my credit report. I have tried reaching out to Capio Partners and I have yet to get a response from them. I never even received anything from Capio Partners informing me this account was sent to a debt collection agency.

Complaint: XXXX XXXX Capio Partners Date : XX/XX/XXXX Re : Acct # To Whom It May Concern : I have previously sent you a request to validate my debt under the Fair Debt Collection Practices Act and all I received was an itemized list of the alleged charges you claim I owe you. This does not meet the Federal Trade Commissions guidelines of what constitutes proper debt validation In addition, in the case of XXXX Vs. XXXX ( IN THE COURT OF APPEALS OF INDIANA, No. XXXX ), the court ruled that : 15 U.S.C. 1692g ( b ) ( emphasis added ). On XX/XX/XXXX, nineteen days after the date of XXXX debt collection letter, XXXX counsel XXXX sent XXXX a letter declaring that XXXX disputes your debt collection-related allegations, denies the same, and demands strict proof and verification thereof. Record at 21. As such, XXXX should have ceased his debt collection efforts immediately upon receiving that letter. Instead, XXXX proceeded to obtain a default judgment against XXXX on the debt collection claim before he had mailed XXXX the necessary verification and, thus, violated 15 U.S.C. 1692g ( b ).
XXXX maintains, however, that there was no violation of the FDCPA because he sent adequate verification of the debt [ to XXXX ] in the XX/XX/XXXX notice of claim. Brief of Appellee at 13. Specifically, XXXX claims that a copy of the consumer credit contract between XXXX and XXXX XXXX attached to the notice of claim provided sufficient verification of the debt within the meaning of 15 U.S.C. 1692g ( b ). We can not agree.
The contract in no way provides sufficient verification of the debt. A review of the document reveals that it identifies only the terms of XXXX loan, including a 17.99 % annual interest rate and the original loan amount of {$2500.00}. The loan agreement contains no accounting of any payments made by XXXX, the dates on which those payments were made, the interest which had accrued, or any late fees which had been assessed once XXXX stopped making the required payments. Indeed, the existing unpaid contract balance at the time XXXX sent the debt collection notice was at least {$350.00} more than the original loan amount. Therefore, XXXX violated 15 U.S.C. 1692g ( b ) when he failed to cease collection of the debt by obtaining a default judgment against XXXX after XXXX had notified XXXX in writing that he was disputing the debt but before XXXX had mailed verification of the debt to XXXX. We reverse the trial courts entry of summary judgment in favor of XXXX on this issue.
I notice that you are still reporting this collection on my credit report, which is considered to be a collection activity. You are now in violation of the FCPDA, and are now subject to fines of {$1000.00}, plus actual damages and attorneys fees, which I may collect from you by filing a claim in small claims court. These collections on my credit report are causing me severe problems in trying to purchase a home and the damage could lead into the $ 1000s.
You should also be aware that reporting such invalidated information to major credit bureaus might constitute defamation of character, as the negative marks on my credit report harm my credit and prevent me from enjoying all the benefits of good credit. In addition, the Fair Credit Reporting Act ( FCRA ) does not allow the inaccurate reporting of information on my credit report and under this act. Therefore, if you do not immediately remove this account from my credit report, you are subject to another {$1000.00} fine, plus punitive damages. I'm sure your legal staff will agree that non-compliance with this request could put your company in serious legal trouble with the FTC and other state or federal agencies.
I intend to follow through with the suit if I do not hear back from you within 15 days.

Complaint: CAPIO PARTNERS has inserted an account in the amount of {$1100.00} representing XXXX XXXX XXXX XXXX. I have never had any business or obligation with CAPIO nor XXXX XXXX XXXX have I ever signed any form related to release any medical history to any companies. This is entirely against HIPPA. I am a victim of identity theft and there is a fraud alert on my credit file. I have also informed CAPIO of this status. CAPIO PARTNERS can not provide a contract bearing my signature that I have any obligation that I would owe or ever owed them any monies. CAPIO PARTNERS has never contacted me regarding the attempt to collect a debt yet they just inserted onto my credit file without warning. there is no contract and never has been one. there is no legal proof bearing my signature that proves that I indeed owe monies.

Complaint: CAPIO has reported two accounts both of which have been disputed and removed by all credit bureaus. XXXX XXXX XXXX just removed it off. Now this company has reported it and 1. Never received written notice that they had it or that it was going to be reported! My info was stolen years ago and that debt is not mine. Plus my info has once again be stolen as I was part of the XXXX breech. They should not be allowed to keep reporting the debt/account once it's been disputed and removed!
Once I learned that this hit my credit I called the company and the man was very rude claiming that i owed it and I need to pay it and said they didn't have to send me anything before reporting it.

Complaint: On XX/XX/2018 I reviewed my credit reports and found that there was an account reporting inaccurate information in my credit files. This account is reporting as a charged off account with a balance of {$500.00}. I wrote a letter and mailed it certified delivery to Capio Partners LLC and requested full validation pursuant to the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. My request for validation including competent evidence bearing my signature and instrument used to secure a contractual agreement where I am obligated to pay you. I made it clear in my letter that the negative marks found on my credit report from the ( 3 ) reporting bureaus from their company or any other company that they represent for this debt that I do not owe is a violation of the FCRA and FDCPA and I request that if this debt can not not be validated you must take steps to have all reporting bureaus delete this entry.
It is now over the 30 day time frame since the mailing of my request to Capio Partners LLC on XX/XX/2018. This company is in violation, they are out of compliance. Under advise, I wish to informed Capio Partners LLC that I am prepared to take steps and file a small claim in my county small claims court. Please be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 { b } that your claim is disputed and validation is requested.

Complaint: Being on XX/XX/XXXX I started to receive calls for the company referenced in this complaint.. the first call I requested over the phone that they send me validation of the debt that they alleged that I owed. The person on the other end of the line refused to give me their name and began threatening to file criminal charges on me and take everything that I owned. I again asked for them to send me validation of the debt that they alleged I owned the person yells at me and said since I refused to pay they were going to send a warrant to my home county and they would be there to arrest me. I hung up following the threats and yelling.. the next day I received a call from this same company. I asked again for them to send me validation of this debt that they alleged I owed.. these calls went on for almost to weeks. When I received a notification that 2 debts had been placed on my credit report. Without validation without written notice of this debt! According to the Fair debt collection practice act I am to receive in writing the notice of this debt before it is placed on my credit file. Also according to the Fair debt collection practice act and Ohio consumer sale practice act they are not allowed to falsely represent themselves as a law office or falsely accuse me of a crime. This debt has not been validated and has become detrimental to my credit score and has prevented me from obtaining financing! I again want the account removed! Until the company can provide me with the information that I have asked for! I still know nothing about this alleged debt! The amount where it came from nothing.. just threats to go to jail. Complaint: I started following my credit on XXXX XXXX a few months ago, and I got notification in XX/XX/XXXX that a debt collector identifying itself as Assetcare/Capio started reporting a medical collection from XX/XX/XXXX. I shouldnt have any medical collections because Ive been insured since XX/XX/XXXX. I wrote what I thought was a pretty detailed letter explaining this and asking for any documentation they have that would explain how or why I ended up with a medical bill which Im supposedly liable for.
I also tried disputing it through the credit bureaus and the same thing happened. I dont understand what kind of game theyre pulling, and its ridiculous that something which to me seems like a random number is now reporting to my credit history, and without any explanation as to why my insurance wasnt billed. Again, Ive received no documentation to justify what theyre doing.

Capio verified this account as mine however they do not belong to me. Capio did not send me a letter notifying me that this account was owed and was being reported to the credit agencies. Capio is continuing to report inaccurate information onto my credit file. Not only that how can Capio verify anything medical with a credit agency being that U have never signed HIPPA form authorizing CAPIO PARTNERS to have access to my patient information.

Complaint: My Husband XXXX XXXX and I previously remitted complaint XXXX and was under the impression based on the company responses this matter was resolved. The Attorney who responded stated I am likely confusing the account with Capio with the XXXX account as to the Capio Account WAS CLOSED as a result of the CFPB complaint last year!! I would like to point out the facts in the response from the Attorney were FLAT wrong!!! Please see the pictures of the collection notices I received and I will subpoena their internal call records if needed! My facts were NOT incorrect as to I spent HOURS of arguing with Capio on the phone then more writing my complaint! Since Capio did the right thing and CLOSED the account, I did not rebuttal the response.

It appears only account stated in # 2 they closed as to I have not heard a word about this one, yet OUT OF KNOW WHERE are harassing my husband and I over Account # 1 stated above!
Not only is Capio Partners still violating consumer protections laws and their own agreement to close the ACCOUNTS, they only closed ONE of the TWO referenced in EACH Previous complaint, and they are now even more so practicing in a UDAAP manner. My husband and I began to receive collections calls for collection account # 1. Please Note the old account number from Capio as stated in my previous complaint that they advised this matter was resolved was XXXX. When I received the calls, I explained this matter had been resolved through my CFPB complaints and the first hung up on me, We then called back and they said Well, the account has been moved to a different department and we are now pursing this. The account number has now been changed to XXXX. Pictures are enclosed for all bill for reference. How / why did this company let this matter go resolved for months on end then all of a sudden transfer the debt to another department and tell me I now owe the debt??? This medical bill was for my SON as explained in the previous complaint. Capio is practicing in an Abusive and Deceptive Manner. They are using trickery by changing account numbers to now say an invalid debt is owed. They are now using a new account number to report an account to the credit bureaus that had already been disputed and removed!!!! If I haft to take out a second MTG to pay for a lawyer to stop this company and their abusive acts and practices, I will!
I would like for Capio to close BOTH accounts as initially agreed upon and STOP harassing my Husband and I!

Complaint: Capio Collections called and said i owed a medical bill. Took me by surprise ; I have so many med bills and we stay on top of them. I believed them because I've been in the hospital practically more than I've been home and it does get confusing. Ive called all of the hospitals, I typically go to XXXX XXXX XXXX XXXX.and every once in a while XXXX XXXX A bill came from Capio stating I could resolve my XXXX dollar debt by paying {$700.00}. So I made the payment on line. Within 2 days I get a call saying i still owed {$200.00}. I said not right now bc i just sent {$700.00}. Se said they '' d take it out late XX/XX/XXXX but not to worry bc the would call first. Then they take money without calling and went ahead and charged {$280.00}. I called and they kept giving me numbers to call until i finally was given the number for the first person I called. Finally I spoke to a man who said yes XXXX was the correct amount. He said my account was now settled. I said do not ever charge my card again bc I'm not giving you permission.The following day I got a bill for # XXXX. Again, nobody will talk to me. I've called the hospitals and they both said I don't owe them anything.

Complaint: I have been making payments to Capio Partners under 2 accounts for 2 years. these are accounts XXXX & XXXX. Payment was being made through XXXX XXXX. Back in XX/XX/XXXX acct XXXX was paid in full & when I called to verify I was informed of 2 other accounts that were misscoded as bankruptcy when they realized that was an error on their part they came after me agressively & I settled those accounts & continued paying on XXXX through XXXX. That account should have paid in full this week so I attempted to verify that & was told after 6 calls to different numbers that they show no record of that account & I owe them nothing to call XXXX. XXXX shows Capio has cashed every payment sent to them even though they claim I owe them nothing since XX/XX/XXXX. Hundreds of dollars gone.no answer.
