Complaint: my loan with bayview loan servicing was sold to XXXX on XX/XX/2015 according to XXXX there was no escrow in my account to transfer to XXXX.my mortgage was then increased by XXXX as you have to have XXXX to start escrow .I can not understand what happened to the escrow acct with bayview loan servicing.i get help from nj tax freeze every year. I can not understand if I had to have XXXX. XXXX for escrow to started with XXXX did I have extra money the the bayview account. also my mortgage was sold to XXXX 2x in one month what is that all about.also I would like this resolved with bayview as it has really messed up my loan with XXXX. I have contacted the dept of banking reguarding both of these companys. as I think they should not be allowed to be in business.

Complaint: My uncle had a little house is XXXX Washington. The lenders kept sucking him into cash out refinance and continued to attempt to do it even after being told he had XXXX. I am a real estate broker and quickly ran comps. He was upside down during the time they were still trying to cash out refinance. The house was worth about XXXX and he owed XXXX. I cleaned up the house so he could go home to live his final days and I cleaned it out more upon his death. I live in Alaska and this involved several trips and time away from my business to do so. The bank then tried to get a default judgment on me even though I was never living in the home, never a signer on his bank account, and never on his mortgage and I lived over XXXX miles away! I had to spend thousands of dollars defending myself from this legal action. My husband and I were in the process of building a home a home here, and this would have messed up our financing! Despite a court order dismissing me from the case, the bank continues to try and collect from me. My uncle passed on XX/XX/XXXX and I 'm filing this complaint on XX/XX/XXXX. XXXX XXXX XXXX XXXX is a predatory lender on XXXX veterans, and Bayview Loan Servicing is unscrupulous company that is violating the debt collection laws. Also, note that I left the house cleaner than any repo I 've handled in my 17 years in the real estate industry.

Complaint: To Whom It May Concern : On around XXXX XXXX, XXXX, I filed a complaint with the Consumer Financial Protection Bureau for a number of reasons regarding how Bayview Loan Servicing was handling my file ( See Complaint # XXXX ).
On XXXX XXXX, XXXX, Bayview responded stating that they suspended the foreclosure process on XXXX XXXX, XXXX and had requested a number of documents for my modification. On around XXXX XXXX, XXXX, I had provided Bayview with all of the requested documents via secure, encrypted e-mail. The account representative, XXXX XXXX confirmed receipt of the documents.
It was stated that my modification would take up to 90 days to complete. From XXXX XXXX, XXXX to XXXX XXXX, XXXX, i had n't heard anything whatsoever from Bayview via mail or e-mail concerning the status of my modification or any missing documents that they may have been in need of. In fear of history repeating itself, I sent XXXX XXXX a follow-up e-mail requesting an update of my modification ( see attached ). I have a tracker on my e-mail that sends me a notification if/when the recipient receives my e-mail. XXXX ( the representative that I was assigned to at Bayview ) received my e-mail that day but chose not to respond.
From XXXX XXXX, XXXX to XXXX XXXX, XXXX, I DID NOT receive a single request for more information from Bayview via mail or e-mail, nor did I receive a modification approval or denial. The only notification that I received from Bayview that even gave the implication that my loan modification was denied was a foreclosure notification that arrived via certified mail on XXXX XXXX, XXXX. Pursuant to 12 U.S. Code 5219a, Bayfiew was supposed to provide me with a denial notification along with other required data. Bayview failed to do so.
Upon receipt of that foreclosure notification, I sent XXXX XXXX, XXXX XXXX and the Hamp Esculations e-mail that was provided in BOTH complaints that have been filed with the Consumer Financial Protection Bureau. In that e-mail, I also placed a tracker to ensure that all parties received it. It was reported that both XXXX XXXX received my e-mail shortly after I sent it but neither of them responded. I did n't expect XXXX to respond because when she went on leave, my file was assigned to XXXX XXXX. However, because XXXX was still my case manager, I expected a response from here. Unfortunately, I did n't so I then called Bayview and attempted to speak with XXXX XXXX. When XXXX got on the phone, I advised her that we were on a recorded line and provided her with my name and phone number. To my surprise, although Bayview states on virtually every call that they are monitored and/or recorded, XXXX REFUSED to proceed with the call to discuss what had taken place with the file. She told me that I had to call her from a different phone. I asked XXXX why she had n't responded to my e-mail and she emphatically denied ever receiving an e-mail from me on XXXX XXXX, XXXX requesting status of my modification.
Because of my history with Bayview, I did n't feel comfortable with having that type of conversation without being on a recorded line so we disconnected the call and I followed up with an e-mail. Once again, I placed a tracker on that e-mail to confirm that XXXX XXXX of Bayview Loan Servicing received my e-mail. This time, I received a " Not Read '' notification from Bayview which generally means that XXXX deleted the e-mail without even reviewing it so that she could properly address my concerns.
I 've waited 72 hours for XXXX XXXX to send me an e-mail with information on what happened to my loan modification and she has absolutely refused to respond to me. This behavior is unacceptable and is discriminatory.
Please help me get this resolved!!

Complaint: In XXXX XXXX, XXXX XXXX, took out a mortgage loan in the name of XXXX XXXX and purchased another property which was put into XXXX XXXX 's name and XXXX perpetrated fraud of which she was convicted and sentenced to prison for Identity theft. The lender at the time was XXXX XXXX XXXX XXXX. XXXX XXXX had kept paying her regular mortgage thinking that it would soon be paid off, but then started to receive notices that her home was in foreclosure, but it was not her primary residence. The property was XXXX XXXX, XXXX XXXX, NJ. She found out that this fraud had taken place, when XXXX XXXX started to send notices that that home was in foreclosure and notified the police, who arrested XXXX XXXX and found the documents attached. Many of which where unsigned. XXXX XXXX forged XXXX XXXX signatures. XXXX took out a brand new mortgage and used those funds to purchase XXXX XXXX, XXXX XXXX, NJ property. XXXX used XXXX ' social security number. XXXX stopped paying on this mortgage in XXXX XXXX and feels that she should not be responsible for this fraudulent mortgage. This mortgage was transferred from XXXX XXXX XXXX XXXX XXXX XXXX XXXX and now Bayview. XXXX is an XXXX XXXX XXXX widow and needs assistance with this fraudulent mortgage. Her home should have been paid off free and clear by now, instead she is facing foreclosure due to this fraudulent mortgage taken on XXXX XXXX XXXX, XXXX, NJ.

Complaint: We have had a mortgage with XXXX since XX/XX/XXXX. We have had some difficulties, a bankruptcy in XX/XX/XXXX and a remod in XX/XX/XXXX, yet we have fulfilled every obligation and have been perfect since the remod. On or about XX/XX/XXXX, we received notice from XXXX 's that our mortgage had been sold to Bayview Loan Servicing, I immediately called them and was told my account was not yet in their system, nothing to worry about. I immediately called XXXX 's and was given the same exact story. On XX/XX/XXXX, I went to the Bayview website and was able to register my account, yet unable to make a payment. I again called Bayview, and was again assured that all was in order, no worries. I the emailed XXXX explaining the situation. To date, I have heard nothing from them. I called Bayview and logged into my account on their website several times over the next several days and was given the same story. More calls and visits produced no better results. On XX/XX/XXXX I registered for account alerts, yet nothing changed. I was told to check back the following Mon or Tues. I logged on Tues, XX/XX/XXXX as that was my day off, and was able to make a payment. I then received a notice of payment email that stated my account was not yet set up and the payment could take seven to ten days to post. I immediately called and was told all was good and there was no need to worry. I expressed my fears concerning a late payment, my credit report and fees. I was assured that none of this could happen and their were grace periods and no fees. I stressed their was no need for a grace period as I had made my payment prior to the 'Late '' date and it was not given earlier because they would n't accept my earlier attempts. I logged on the website several days in a row, hoping to see the payment posted. I finally called XX/XX/XXXX and was told that my mortgage had been transferred to Bayview due to my bankruptcy and risk. I asked what any of that had to do with posting my payment. I asked for a manager several times and was belittled and berated each and every time. I was then put on hold for an extended period of time. No one ever returned to the line. On XX/XX/XXXX, I received an email from Bayview stating that I could now view my online account. I logged on and saw that I was now due for an XX/XX/XXXX payment. I finally thought things had been corrected. That 's when I saw the 'Request Payment History ' tab. I thought that was odd language, " Request '' most website openly display your payments. I clicked on the tab in an attempt to confirm my XX/XX/XXXX payment. I was promptly thrown off the site and my password no longer worked. My next business day off is Tuesday, XXXX XXXX and I had planned on calling Bayview the. Today, XX/XX/XXXX I received a paper statement in the mail showing two payments due by XX/XX/XXXX, stating I was behind a full payment. I had made my payment to XXXX in XX/XX/XXXX. I have taken the time to review Bayview Loan Servicing and what I have experienced, and much worse is the norm. I have contacted XXXX, your agency and will be meeting with legal counsel. Complaint: I have been with Bayview Loan Servicing Company since XXXX 2013. I currently pay my homeowner premium and taxes in my monthly mortgage payment. On my most recent mortgage statement, I was charged a fee of {$75.00} for " rec corp advance ''. When I called the customer service dept, I was told that this was a corporate advance fee due to insurance verification. They had no other details regarding this fee. I called the insurance dept at Bayview, who had no history of any kind of bill that was paid on my behalf to the insurance company for this. I also talked to my homeowners company who stated they did not request, or complete, an insurance verification and did not bill my mortgage company. I called back the customer dept at Bayview who again said this was a corporate advance fee and advised me to fax or email Bayview requesting a breakdown of these fees, which is absurd. Why should I have to email or fax a request to find out why they are charging me a fee? I would expect the customer service rep, and especially a supervisor, to know this information. I asked the rep for a copy of the bill, which she could not provide. The rep spoke to her supervisor who also could not provide me any information on this fee. Again I have been with Bayview for 3 years and I have never had a charge like this and I have never had any inspection from my homeowners company. This fee does not seem to be legit due to the fact that no one has any answers for me and could not provide me with any kind of proof. I am very upset and do not know how a company can just place a fee on my statement and expect me to pay it when they do not have any proof that any kind of verification was done or any bill showing they paid it. This company has been a headache and they are always very unprofessional when calling in to speak to customer service.
They are also charging me a {$20.00} fee for a payment that was late due to the fact that the bank account information was entered wrong. I requested to have this fee removed since we have never been late and this was an honest mistake ; however, this was denied. How can a company not even give a courtesy fee removal one time for a customer who is in good standing with their account?

Complaint: CFPB : Greetings ...
I have a Mortgage on my home at that is being serviced by Bayview Loan Servicing , LLC ( www.bayviewloanservicing.com ). Bayview has been servicing my loan since XXXX XXXX, when it was transferred to Bayview from XXXX XXXX Bank.
This complaint is about a {$150.00} fee that was listed on my Monthly Mortgage Statement dated XXXX/XXXX/XXXX ( for payment due on XXXX/XXXX/XXXX ). The fee was listed as a line item on the statement and labeled as " Total Fees & Charges ... {$150.00} '' My eldest son and I called Bayview Loan Servicing at XXXX ( customer service ) with various phone calls the day after receiving the Monthly Mortgage Statement in question. It took XXXX different phone calls to get the information that we needed as the Bayview representatives repeatedly kept making different requirements and reasons to release the information over the phone. Finally, after XXXX different phone calls, we were told that the " fee '' was actually XXXX different " fees. '' We were told that these were " Brokers Price Fees for Property Evaluation '' We were told these fees were {$75.00} each and that XXXX of them had been added to the account : XXXX fee back on XXXX/XXXX/XXXX, and the XXXX fee on XXXX/XXXX/XXXX. We were told that the XXXX fees totaled the " Total Fees & Charges ... {$150.00} that appeared on the XXXX/XXXX/XXXX Monthly Mortgage Statement ( this this month 's statement ).
We advised Bayview Loan Servicing , LLC, customer service representative that we had not requested a " Broker 's Price Fee Property Evaluation, '' and furthermore had never heard of such a thing or fee on any Mortgage Loan we had ever held with any company, in addition to Bayview Loan Servicing , LLC .
The Bayview Loan Servicing Representatives told us that the Mortgage Loan was paid-up and current ; not in arrears and that the payment for the {$150.00} aforementioned fee would not be required as it was added to the Mortgage Amount. We were told that the normal monthly mortgage payment of {$1000.00} would be the payment due on XXXX/XXXX/XXXX and that there would be no changes to the monthly payment amount now or in the future.
So, in summary, I am asking the Consumer Financial Protection Board to look into the reason for the so-called " Broker 's Price Fee - Property Evaluation '' that was apparently added to the Mortgage Amount without our knowledge, consent, or approval. I believe this so-called " fee '' is unlawful and in violation of the various consumer credit and debt collection acts and the National and State of Minnesota levels. I would like Bayview Loan Servicing to explain in writing and in accordance with all Federal and State laws in the Great State of Minnesota, why the fee was added to the mortgage and mortgage account ; why we were not notified until over 1 to 2 years later ; why the so-called fee is not labeled correctly and explained on the Monthly Mortgage Statement. I would also ask that Bayview Loan Servicing cease all predatory financial practices and the use of hidden, predatory and unlawful fees and charges to it 's Mortgage Servicing customers.
I am aware of the current order and fine imposed on XXXX for customer and fee abuses at that bank. I am asking that the XXXX do the same for Bayview Loan Servicing , LLC .

Complaint: I am currently in a modification program with Bayview Loan Servicing. I was initially denied the modification in XX/XX/XXXX, but received a notice that trial payments were to start effective with the XXXX 2016 payment. I sent my first payment due XXXX XXXX, 2016 via USPS certified mail. The payment was sent on XXXX/XXXX/16 and arrived on XXXX/XXXX/16. I received my green card and knew how long it would get there. My payment for XXXX 2016, I just sent via regular mail because I did not have time to go to the post office. I mailed it on XXXX/XXXX/16. Today if XXXX/XXXX/16 and the payment has not posted to my bank account. I 've tried calling the customer service number ( XXXX ), but all I get is that no one is available to take my call and that the voice mail is full and I can not leave a message. I 've also sent an email on XXXX/XXXX/16 to customer inquiring about the status of my payment and why it has not been posted. I 've read complaints about this company and of how they will hold payments to make you appear late to either disqualify from your modification plan or report you to the credit bureau. I feel that is what they are trying to do to me. As of today, I will be sending Bayview customer service another email informing them that I will be placing a stop payment on the check that was mailed and that I will be processing the payment over the phone. I do not want this to disqualify me from completing the trial payments for the modification which I feel Bayview is trying to do.
