Complaint: A court order of citation to discover assets was issued on my accounts at Bank of America. My account was frozen subsequently and I had to go to court to defend myself. I went to court on XX/XX/2015 and the court ruled in favor of me and ordered that bank of America return any and all monies or other property withheld. And the court also ordered that the citation to discover assets be dismissed. I gave a copy of the court order to Bank of America and they have still not released my account. My account is still frozen and ca n't use it and I am still being charged monthly maintenance fees. I have on numerous occasions communicated my fustrations to bank of America but has still not received any fruitful outcome. I would like for your organization to look into this matter. Thank you.

Complaint: I have previously submitted a complaint against Bank of America ( Case number : XXXX ) in XXXX, 2016. I had received notice that the company would resolve the issue and did not dispute their response right away. I have been unable to navigate a response on the previous complaint number XXXX and have been unable to reply to the emails. This complaint is in regards to Bank of America 's failure to adhere to their proposed resolution of removing the escrow charges from my payment despite my compliance in paying the escrow balance to XXXX. Bank of America has filed a notice of Default and Intent to Accelerate, it has aggressively made harassing collection calls, and continues to assess escrow on my mortgage payment nearly doubling the original payment. I have written to Bank of America at various departments explaining that the agreement was to have the escrow ( which was wrongfully assessed ) removed once I repaid the escrow amount they never should have paid, having done so in violation of a legally binding agreement we had signed with the XXXX County Tax authority which Bank of America was provided with notice of. I have written to a consumer division of BOA regarding the proper payment with no prompt response. My XXXX payment is already late and I want to pay the original and correct amount as agreed to, however BOA refuses to reduce the amount they claim is owed. My credit has already suffered due to BOA actions in increasing my original payment of {$480.00} to {$1000.00} and now {$860.00}. We took a huge financial loss in trying to pay these excessive amounts and now that we have paid the escrow to a XXXX balance they maintain that I am liable for the improperly imposed escrow. Time is of the essence since the taxes will be due for 2016 within 30 days and if they wrongfully pay these again they will insist that we repay them with doubling our mortgage payment. If allowed to pay ourselves as legally entitled, my husband is a XXXX vet and over the age of XXXX and is entitled to make payments to the county in a more affordable payment plan. BOA is attempting to further violate our rights by imposing yet once again an improper escrow in order to force us to pay double our initial mortgage. I am unable to send any supporting documents via this system so I will send a follow up correspondence with copies of all my correspondence to Bank of America..

Complaint: XXXX is agresively attempting to collect debt for Bank of America. When I requested them to validate these debts I got NOTHING back. At the same time bank of america validate the ownership of this debt ( see attached letter ) and stated they were NOT connected to XXXX XXXX .... XXXX XXXX asked for financial statement in order " to help me negotiate and settle this debt '' after providing them with all of my personal information I got NOTHING back ... is this even legal to do? ... Bank of America still has the ownership of these credit card debt notes and I was advised to settle with them. However XXXX XXXX has NOT stopped harassing me, I can never speak to the same person and have to give them my personal info ss # date of birth and etc over the phone to the secretary before I can be transferred to someone .... who knows what she does with my identity and why am I required to shout out my social over the phone to someone I do n't know ... this is a violation of my consumer rights and privacy this must be stopped!

Complaint: I 'm dissatisfied that Bank of America is charging me {$5.00} to replace a defective debit card they forced on me with the " enhanced chip technology. '' The chips are so fragile that unless you keep each card protected in a silk sleeve, locked up in a safe deposit box 3 stories underground with an armed guard, it 's not going to last. Every checkout person I 've talked to says it 's incredibly common, so I know Bank of America is replacing countless debit and credit cards for their customers due to defective technology, but instead of doing the right thing for the customer and replacing the card for free, they charge {$5.00} and leave the customer with the impression that it must be our fault. Sure, it 's the customer 's fault. Is that the brand Bank of America wants to promote?

Complaint: Bank of America , N.A . ( BANA ) has wrongfully denied me a home loan modification program offered by the United States government. Specifically, I have been incorrectly denied a Making Home Affordable ( MHA ) Home Affordable Modification Program ( HAMP ).
On XX/XX/XXXX, BANA incorrectly denied me a MHA HAMP. XX/XX/XXXX, a timely appeal was made. On XX/XX/XXXX, the Bank of America Appeals Department conducted an appeals review and issued an Appeal Report by an Appeals Specialist granting MHA HAMP. On XX/XX/XXXX, the then assigned single point of contact ( SPOC ) XXXX XXXX, issued what is represented to me as a determination on appeal denying MHA HAMP. This Customer Relationship Manager ( CRM ) and SPOC also made this knowingly false representation to me on XX/XX/XXXX and again XX/XX/XXXX as stated, represented, and confirmed by Customer Relationship Supervising Manager XXXX XXXX on XX/XX/XXXX.
To date, not a single assigned CRM or SPOC has provided or confirmed with me the determination made on appeal by the Appeals Specialist of XX/XX/XXXX. To date, no written determination has been provided to me issued by the Appeals Department based on the Appeal Report of XX/XX/XXXX.
On XX/XX/XXXX BANA caused to be recorded a Notice of Default ( NOD ). On XX/XX/XXXX, BANA caused to be recorded a Notice of Trustee Sale ( NTS ). A Trustee Sale at auction is scheduled for XX/XX/XXXX. To my knowledge, the sale of my home has not been cancelled and no Rescission withdrawing the NOD and NTS has been caused to be recorded.
Bank of America lied to me for four ( 4 ) years during and throughout the modification process. Escalated cases have been opened related to the above events, reference numbers XXXX of XX/XX/XXXX and XXXX of XX/XX/XXXX.
I am not going to stop Bank of America BEFORE the wrongful sale of my home ; Bank of America has to stop themselves.
Mesne profits are sums of money including, but not limited to, sale price or proceeds, rents, or profits paid, gained, or accrued for the possesion, occupation, or control of real property and improvements to a person without right of immediate occupation, where no permission has been given for that occupation during the rightful owner 's exclusion from his real property or home.

Not only must Bank of America pay me back, to include mesne profits, Bank of America must also repay the tax payers all amounts associated with this account. Complaint: I have been a customer with Bank of America for over 16 years. I have a credit monitoring service that contacted me regarding possible Credit Card ( CC ) issues that will affect my credit rating. The card was issued by Bank of America ( BOA ) and according to them I was a co signer. According to them this was for my daughter and done XX/XX/XXXX. The report to my XXXX rating account was due to the card going overlimit ( Not for non payment ). I canceled the CC so further issues were not created, and requested they investigate the matter as I had no record of this. BOA sent me a Fraud application to my accurate address dated XX/XX/XXXX. Since I did not know anything about this card my daughter said this was her card and I told her I had canceled it and she could get another, and she needed to pay off the balance. I was never contacted again. XX/XX/XXXX I was offered a CC by BOA for a XXXX. I applied and was given a card with a 25 % interest fee. When I checked my credit report I found that BOA was reporting that I had not paid the questioned account we discussed XX/XX/XXXX. BOA had all the information to help correct the problem. BOA has not contacted me with a demand notice or any further request to clear the CC issue but they did kept sending to the credit report companies I was Not paying my bills. BOA now have a way of posting to my Credit account deficiencies I know nothing about but will still give me credit at high rates!!
So a BANK of AMERICA can ruin a persons credit then offer them credit at much higher rates because of low credit scores that Bank of America inflicted on the consumer. I spent over 12 hours trying to get them to correct my credit report. I was advised that the CC was paid in full, I am not in cummunication with daughter but via third party told her to pay the bill - however BOA will not correct the damage to my credit rating. Complaint: Our firm, XXXX has been monitoring our client 's request for mortgage assistance to Bank of America to ensure its compliance with Regulation X. For the past few months, our client has been trying to get her application reviewed by Bank of America however, Bank of America has failed to act diligently and now our client faces a serious concern of losing her home. The borrower submitted a Loss Mitigation Application to Bank of America on XX/XX/2016 via facsimile transmission. We emailed an exact copy to Bank of America 's counsel at XXXX ( " XXXX '' ) on XXXX after discovering XXXX specifically requested the borrower direct any and all loss mitigation communication to their office only and not to send anything directly to the bank. An attorney at XXXX confirmed with our firm the borrower 's Application was submitted to Bank of America for review. Subsequently, XXXX requested additional documents from the borrower needed to complete the review of her Application. All of the requested documents listed in XXXX letter were submitted to XXXX by the stated deadline via e-mail and certified mail on XX/XX/2016. Pursuant to a letter from XXXX dated XX/XX/2016, there was no foreclosure sale scheduled as of the letter date according to Bank of America.
After receiving a separate letter from Bank of America regarding the documents needed for the modification review, we sent an email to XXXX to confirm the list of items we received from their office on XX/XX/XXXX was up to date and an accurate list of all that was needed for the review. XXXX confirmed via email that the list they sent us was correct and advised that the documents we submitted to them on XX/XX/XXXX were being reviewed by Bank of America and they would advise if anything further was needed. Nothing further was ever requested by XXXX or Bank of America after we submitted the additional documents on XX/XX/XXXX. The borrower never received any notification or information pertaining to the results of her loss mitigation review. Despite the foregoing, our client was notified there is now a foreclosure sale date scheduled for her home. We believe this is clear violation of the prohibition against dual tracking pursuant to 12 C.F.R. 1024.41 ( g ).
Additionally, we received a letter from Bank of America a few days ago alleging it never received a complete application from the borrower. We believe this to be an inaccurate statement and error given the aforementioned chain of events and communication between our office and the attorneys at XXXX. At no point after the borrower submitted the requested documents to XXXX as instructed on XX/XX/XXXX did Bank of America or XXXX request additional items or inform the borrower that her application remained incomplete. Pursuant to 12 C.F.R. 1024.41, Bank of America is required to diligently review applications and promptly request additional documents when necessary.

Complaint: I entered in to a Mortgage loan agreement with Bank of America , NA in XX/XX/XXXX, 2 years later I was notified XX/XX/XXXX that I was XXXX. I was a XXXX on XX/XX/XXXX and requested the SCRA Protection on all of my pre-service obligations with Bank of America several times of the 9 year period I continually XXXX XXXX as defined under the SCRA military service. I was denied the SCRA provisions on all of my accounts with Bank of America , NA and had adverse credit reports filed with all of the Credit Reporting Agencies from XX/XX/XXXX and it has Continued to the present. My mortgage loan account number ending in XXXX was charged interest in excess of 6 % until XX/XX/XXXX, I paid everything amount that had been demanded of me, I struggled at times due to the increasing amount charged to all of my accounts. Bank of America controlled my military pay and when all my payments would be applied to my accounts with them and all of my other creditors, this resulted in late fee, over draft fees, return check fees and I never knew what my balance would be from one day to the next. I was constantly dealing with the threats of Foreclosure on the home in XXXX, XXXX were my family lived, and I was offered payment modifications to reduce the amount required, but Bank of America wanted me to sign documents stating that I had defaulted on the mortgage and was financially unable to make my payments, to be considered for a reduced payment plan. I worked XXXX job and preformed all my military duties for 3 years, just so that I could do what I to do for my family and continued to make the payments demanded, and I never agreed to a modification until XX/XX/XXXX. XXXX, but when I checked in with my XXXX, I was dropped from XXXX, my pay stopped after XXXX and I XXXX just to have a pay check while I was waiting to XXXX. I had to call Bank of America and explain that I was n't being paid, I was offered a loan that was not a modification of my original XXXX mortgage loan. It was explained as a separate loan to cover the payment amount needed and would be billed separately, it was called a Home Saver Loan, I had it mailed to the house in XXXX and it was XX/XX/XXXX and I had n't been paid, so I drove down to sign the document the day before I was going to XXXX. It seemed to be just as it was explained over the phone and I was n't going to leave my kids in a Foreclosure situation while I was in XXXX. I had activated my XXXX when I finally got paid and I made my XXXX mortgage payment online, a few days later I got a call informing me that a Notice of Intent to Accelerate was sent to my home under a XXXX loan number. I called Bank of America and was told that my mortgage was fine, my payment was applied and my loan was still being processed, then a Debt Verification letter was sent with the XXXX mortgage number, stated XXXX owned our mortgage loan, and then a letter from Bank of America dated XX/XX/XXXX said our XXXX mortgage was being transferred for servicing to Bank of America Home Loan. I was in XXXX processing for XXXX and that was the first time I was informed about the Foreclosure on XXXX Servicemembers, and the pattern that it had taken, so we started filing complaints with any Agency we could think of, we met with a JAG Attorney, disputed the XXXX mortgage debt and XXXX legal right to collect payments from us. Our XXXX Mortgage history was gone, everything had been replaced with the XXXX mortgage account, which only went back to XX/XX/XXXX. We were advised that any payment to the XXXX is seen as an agreement!

Complaint: I received notification from Bank of America ( via their XXXX app ) that I was pre-approved for a secured credit card. I submitted my application, online, and was notified immediately that it was under review. I received XXXX letters dated XXXX XXXX. 2016. The first advised that my application will be approved once the collateral ( {$99.00} ) has been verified by my bank ( also Bank of America ) and it states the card would be sent within XXXXXXXX business days. The second letter stated that I need to contact Bank of America to provide the requested collateral within 60 days. I called today XXXX XXXX ( on my vacation day from work ) and was advised that my application had been closed, and the rep XXXX '' advised she could re-open it with my collateral today. She then advised after attempting to re-open my my application I was denied based on my credit report. I advised that my letter said I was approved pending my collateral and explained that I had not received a letter that my application was closed no that I was denied due to my credit report. I told her I do n't understand how that could be considering I just received an approval letter and no denial letter.
