Complaint: My debit card had an unauthorized charge by XXXX which caused the account to go negative. Bank of America immediately hit me with a overdraft fee. First I called XXXX, their customer service people quickly admitted the error and issued a refund which would take XXXX days to process. I then called Bank of America, they said they would n't do anything until all the transactions posted then they would refund the overdraft fee and remove it from my records. So I waited until then, I have since called them XXXX times, once I was on hold for so long I gave up, the XXXX time I kept getting bounced around different people. XXXX dept says since it was n't technically a fraudulent charge they ca n't do anything, another dept says they ca n't do anything because they state that this in fact a fraudulent charge and the other dept needs to issue the credit. The XXXX time I was hung up on by the employee.

Complaint: In XXXX I became the victim of identity theft. I filed a report with the Police Department. The amount of the theft was close to {$50000.00}, or my life savings. My perfect credit was was ruined. Further, it was not possible to go after the person who had defrauded me ( he posed as a financial advisor ) because he died in XXXX of XXXX. It was information I discovered after I learned of his death that I found I had been defrauded. After I supplied copies of the Police Report to all the companies trying to get payments from me for things I had never charged, all but one of the companies and banks trying to collect money from me dropped their attempts to do so. The only one that has continued to pursue me is the Bank of America. Even after I, a senior on a limited income and now no savings, went to a lawyer and had him repeatedly contact the B of A, they would not relent. The Bank of America and all three of the credit report companies have received copies of my Police Report. After several years of frustration in this matter, I asked the man who helped me with my taxes, a XXXX, to contact the Bank of America. He did and they said they would stop asking me to pay back some $ XXXX, BUT they sent a form to him that said I had received that amount and had to pay taxes on it! The kind CPA said he would attach a letter and my Police Report to the IRS and they would not ask me to pay tax on it, as I had not ever made those charges. BUT after the IRS honored my XXXX 's letter, when I checked my credit report, the $ XXXX was still there from the B of A saying I owed them. The credit report companies ( XXXX, etc ) said there was nothing they could do about it, and the B of A could leave the charges there until XXXX, XXXX. I need your help to stop this. The Bank of America has already received copies of my Police Report as have each of the credit report companies.

Threatened to sue on too old debt
Complaint: On XXXX XXXX, XXXX, I was only approved for only {$1000.00} limit BofA Credit Card BECAUSE BofA said in writing I still had a {$50000.00} open line of credit with the firm!
the bank stated the personal commercial line of credit for {$50000.00} was still open at prime plus XXXX pts and i was welcome to use it. When I tried to use it, I was told it was too old to use anymore and that I had to request it be closed and to ask for a new one that meets current BofA loan guidelines. So I did. but, no one has updated my credit reports to show it was closed, never late and paid as agreed.
I have spent the past five months haggling with BofA mortgage dept to close the commercial line of credit and update my credit report it was paid in full & never late to no avail. That is a FCRA requirement! it has been open since XXXX and never closed by BofA due to negligence!
I also asked them to terminate my personal Guarantee as well. I received a letter XXXX XXXX, XXXX that the loan was finally closed and my guarantee was terminated and that the credit report would be updated as paid as agreed, never late and closed. THAT NEVER HAPPENED!
BofA archives Dept, Credit Card Dept, Commercial Mortgage Dept and Executive Resolution Dept each apologized for the FIVE month mixup until today.
In a letter XXXX XXXX, XXXX, Pa A Mortgage some Resolution Specialist threatened to sue me if I contacted the bank again. I consider this an FDCPA violation and an FCRA violation and I want CFPB to order BofA to update the XXXX major Credit Reporting agencies I paid my bill off as agreed, never late and it is now closed!
ALL I WANT IS MY CREDIT REPORT UPDATED THAT THE LOAN WAS PAID OFF AS AGREED, NEVER LATE AND CLOSED XXXX XXXX AND THAT I AM NO LONGER LIABLE!

Complaint: This is my second CFPB complaint for this same issue and after multiple complaints with the bank. For the second month in a row, after they had advised you all and me that the issue was resolved and I could pay money towards my principal, this has not been the case. My last two principal payments were applied against future interest payments. This then causes me to be on the phone with the bank for a long amount of time trying to get the payment reversed back to principal. Last month I lost money as they did not backdate the payment date so they kept some of the interest they charged me. This month, the representative advised that they would backdate the payment so I would receive the full benefit of my payment.

Complaint: I have a credit card with Bank of America. I could n't figure out how I always had a balance carried forward even though I always paid the " current balance '' in full before the due date.
Then I realized : the bank has set my payment due date BEFORE the end of the finance period, so that unless I do n't use the card, some charges will be posted after I make my timely payment.
Example : my B of A payment is due on XXXX XXXX. I pay the full balance on XXXX XXXX so as not to be late. In XXXX, I find a 'beginning balance '' amount, on which interest has been charged, for transactions on the XXXX, XXXX, and XXXX of XXXX. They are listed as having been retroactively due with the XXXX payment.
Is this not dishonest? Sneaky? Possibly Fraudulent??? How many billions do these guys collect in interest from people who think they are paying in full every month?

Complaint: exact same story as another consumer so I will use his words with my specifics : I enrolled in an HSA account with B OF A with a previous employer and left that company with a balance on the account. The bank will not allow me to withdraw funds without paying a service fee ( {$25.00} ) to do so and have slowly been bleeding the account dry by applying monthly service charges ( {$5.00} ) on it.

Complaint: I applied online for a credit card thru Bank of America was 0 % interest. I th I thought it was for a special promotion for more than a year. I called the bank and asked for the contract. They sent me something else with a later saying this is best imformation we have with a number. I called number and it was wrong number to call, finally I had to call the number on my credit card and rep said that was business account number and my account an individual account. He then stated he was sorry but the rep sent me the wrong paper work. He said he would send the contract I signed. It was terms and conditions and I do n't see anywhere one there saying it was for one year! If I did that 's fine I will abide to it. I just saying I thought it was 16 or 18 months.I asked if they would lower my interest rates even they would n't do nothing for me..i been a long time customer of Bank of America and a XXXX.

Complaint: On XX/XX/XXXX at approximately XXXX Bank of America representative by the name of XXXX of the Foreclosure Department acknowledged the existence of the Bank of America Appeals Department XX/XX/XXXX Appeal Report during our call. Because of this admission, I requested the matter be escalated and was provided an escalated case reference number of XXXX.
The above referenced escalated case concerns the fact that it took Bank of America a year to issue the report on Appeal of the incorrect MHA HAMP denial of XX/XX/XXXX and never provided me with a written determination on Appeal from the Appeals Department to date.
During the year of lies, Bank of America Underwriting Department proceeded to use unfair, poor and deceptive practices to persuade me to reapply for mortgage assistance, file for bankruptcy, or abandon my home. I did none of these things. Bank of America Underwriting Department also issued a multitude to letters to me stating I had been denied a MHA HAMP TPP on Appeal, which is not true as evidenced by the Appeals Report.
As late as XX/XX/XXXX Bank of America is representing to me I have been removed from the modification process and no complete mortgage assistance application is currently under review. However, Bank of America never states why I have been removed from the modification process in the first place.
Bank of America was representing to me that I never provided a complete RMA since XX/XX/XXXX. When I pointed out an initial review had been completed XX/XX/XXXX, Bank of America then changed this representation to there is currently no RMA pending review because I will not reapply for mortgage assistance after the Bank of America Appeals Department XX/XX/XXXX review and determination that I have not been notified of to date. While I have n't reapplied for mortgage assistance due to the Bank of America Appeals Department determination, Bank of America has erroneously represented to me my XX/XX/XXXX RMA for a MHA HAMP TPP was denied and due to denial on Appeal, is no longer pending as it has completed and exhausted the MHA HAMP modification process. This is simply untrue.
Bank of America is also representing to me I have received decisions on all of my complete loan modification applications and appeals and all MHA HAMP guidelines have been followed. This is also untrue as Bank of America has never provided me any determinations on appeal related to my complete RMA application package submitted on and before XX/XX/XXXX. While the California Homeowners Bill of Rights was not in effect until XX/XX/XXXX, RESPA enforced by Regulation X was effective XX/XX/XXXX, so the legal requirement of a written appeal determination was present at the time of appeal request. Furthermore, I made repeated requests for a written determination on XX/XX/XXXX appeal on and after XX/XX/XXXX, but Bank of America admittedly did not provide one to me to date and the internal Appeals Department report and documentation of XX/XX/XXXX is after the California Homeowners Bill of Rights came into law clearly requiring Bank of America Appeals Department to issue a written determination to the borrower upon reaching a decision. Bank of America has never produced any RMAs ( other than XX/XX/XXXX ), or Appeals Department written determinations.
