When CFPB allow this improprieties happen, it deprived Complainant from have access to vital information that is need to solve this matter. New evidence show that XXXX is not Trust of the Mortgage according US Securities and Exchange Commission ( SEC ) records shows that pooling servicing Agreement ( PSA ) XXXX XXXX XXXX Home Equity Loan Trust, Series 2006-FM2 Asset-Backed Pass-ThroughCertificates XXXX 2006-FM2 was purchased by XXXX XXXX on XX/XX/XXXX and all of its the residential mortgage ( RMBS ) place into the new PSA called XXXX XXXX XXXX XXXX XXXX XXXX XXXX Trust 2013-C7, which consolidated different type commercial and residential pooling Servicing Agreements. THE FOLLOWING INFORMATION IS REQUESTED IN WRITTEN : 1. copy of all evidence, allonges, blanc endorsement of the note that XXXX as the note holder of the above mortgage. 2. Complaint: I had fallen behind on my mortgage and was in foreclosure. I applied for a loan modification in an effort to save my home. On XX/XX/XXXX I was denied for a loan modification but approved for a repayment plan. The conversation I had with an SPS representative is attached. Although I followed through with the repayment plan, SPS sold my house at auction on XX/XX/XXXX. That sale was vacated, I have attached the docket for my foreclosure case. The certificate of sale is document # 27. I continued to make the repayment plan payments, please see plaintiff status update filed with the court XX/XX/XXXX stating I have made every payment on time. On XX/XX/XXXX I had the following conversation with an SPS representative - " spoke to XXXX XXXX and his position is the investor just wont review / he can short sale / does not care what was promised or that the client followed through for a whole year ". I am now asking the CFPB to examine this situation because I believe I have been lied to by my mortgage company. I was told I could continue the repayment plan until I was current, after one year they refuse to review when I was promised. I did my part and I feel this is unfair, thank you.

Complaint: My loan transferred to Select Portfolio Servicing XX/XX/XXXX from XXXX XXXX. SPS took 4 months to process my transfer. While my account under " process '', I kept paying my monthly mortgage on time started XX/XX/XXXX. I did not miss any payments. All my payments were sent on time. SPS acknowledged that they received all my payments on time, however, they did not apply all the payments on time. They applied all payments as single payments on XX/XX/XXXX. I asked SPS to fix my payment records and to apply all the payments individually as they received them on a monthly basis. Since it wasn't my fault that it took them 4 months to finalize my account. However, they stated that they will not fix my record payments. They said that they had to apply my payments under " suspend account " because my loan modification documents from my previous servicer were not received. I am now trying to refinance my loan and the underwriter will not accept my " payments being on time '' because SPS will not provide the proper documentation of the payments that I made during " transfer process '' I called SPS several times and spoke to different representatives to fix these payments records and they stated that they will not able to go back to my record and fix the payment history.

Complaint: I had a mortgage with XXXX XXXX XXXX. My servicer changed to Select Portfolio Servicing Inc further referred to as SPS Inc.. When I logged into their website to make my first payment this month they charged me an additional {$15.00} to make the payment online and called it " EZ payment '' This is an additional fee I need to pay to make my mortgage payment each month. My amount due is {$1500.00} but I will have to pay {$1500.00} monthly for my mortgage. By charging the fees to pay online or over the phone, a portion of which it retains, SPS Inc is in violation of the federal Fair Debt Collection Practices Act, which prohibits the collection of any amount ( including any interest, fee, charge, or expense incidental to the principal obligation ) unless such amount is expressly authorized by the agreement creating the debt or permitted by law. This amount is not authorized by my mortgage agreement and was never charged when I payed online through XXXX XXXX XXXX the originator. It should be criminal that this company is making me " pay to pay '', to wonder people go into foreclosure.

Complaint: We have been trying to get a short sale approved since XX/XX/2019. We gave complete all paperwork and follow the instructions of the servicer SPS. They advised us that the XXXX came in at XXXX and we need to net 80 % of the value. We did this and the net was XXXX. We got this with a XXXX purchase price. The servicers came back and said the price was too low. This would have been our third offer, so we have asked them to give us a counteroffer and they constantly say they can not provide this to us. We have been going round and round. If you can please assist us with getting a counteroffer so we can please get this short sale approved and closed. Complaint: SPS has unrealistic value on short sale property. Our property is distressed and underwater and we have been trying to work with SPS. We had THREE offers. Two dropped out because of length of time it took for SPS to get back to buyer on response of acceptance. They were soooo slow buyers would not wait any further. Each offer was between 1.2 and 1.3 million. Our home has been on the market 450 days. We FINALLY got another offer at XXXX and the buyer said they would hang in there while SPS did their review. Now SPS is stating they won't review because offer is too low, however, it's the same value as the prior offers of XXXX. The appraisal done by SPS was inaccurate and flawed and used properties outside of our town. I'm submitting support information.

Complaint: On XX/XX/2019 XXXX informed me that my home owner 's insurance would not be renewed as of XX/XX/2019. This because they did not want to pay for roof repairs that they deemed a necessity. That's the best they could do for me after fifteen years of my paying them for coverage. After all that, my mortgage servicer ( SPS ) sent me a letter stating that they 'may ' purchase insurance to cover a lapsed period ( XX/XX/19 to XX/XX/19 ), and that they 'may ' charge me for their purchase. Before my XXXX policy expired, I talked to one of SPS 's representatives to let them know that I was searching for replacement insurance. The representative told me that I had time to get the insurance, even after my current insurance expired, I would just have to be timely in letting them know once I had the coverage. I sent proof of my new home owner 's insurance as soon as I purchased it on XX/XX/19. More than a month later I get a letter from SPS saying that they had purchase insurance to cover the lapsed period, after the fact, and that I would have to pay them for their purchase. So, they have added the charge to my mortgage escrow account. That should be illegal. They say that I signed a statement agreeing to keep insurance covering the property. However, they have not provided proof of my signing any such statement, nor have they provided proof that I agreed to pay for any insurance that they 'may ' purchase if I did not keep insurance current. Where do these large companies get the idea that they can do something so unreasonable as purchase insurance after the fact, covering a period of time that has long past? I should not be expected to pay for their delayed actions. No doubt they are making plenty of extra money with this practice off the backs of so many of their customers. I just wonder what other tricks do they have up their sleeves to collect money from unsuspecting home owners. I want this charge removed from my account immediately.

Complaint: I dont even no where to start. My mother in-law that my husband and i own our home with she is being manipulated by SELECT PORTFOLIO SERVICING INC. there is a foreclosure date set for XX/XX/XXXX 5 days from today. 3 of those are weekend or a holiday. She called on the XX/XX/XXXX. and was told the request went in to postpone while her complaint was being reviewed. she has been calling every day since that day and is told to call back. She received 2 letters stating that her review would not be completed before the sale date. one dated XX/XX/XXXX and the dated XX/XX/XXXX. i came home to her crying last night. we have know where to go .She is XXXX years old this stress is way to much We spoke SPS again at XXXX XXXX this morning we were told they same thing i was on the line with her. they said it was sent in for postpone but she really was lying to us. she said call back on Saturday Monday is a holiday. I took the day off work to try and help with all of this. XX/XX/XXXX we spoke to QUALITY LOAN CORPORATION the acting foreclosure company on our home she sated no postponement had been requested and the house set to be sold on the XX/XX/XXXX. We have a letter dated XX/XX/XXXX that states no foreclosure will be held during this time. The appeal has been sent SPS along with this complaint. to them .This has to stop date manipulation so nobody has time to do anything or no other options have been given. XX/XX/XXXX we were told that the preforeclosure check was approved when my mother in-law asked what that meant the lady got super upset. Which leads us to believe they have no intentions of stopping the sale. They are moving forward during our appeal time. so they can just sale they have not given us any non retention offers except to get out. We are appealing a denial we received for a loan modfication which states we did not complete the paper in a timely fashion. Which is false.Im asking for help we can not possibly move out and find a place this quickly. The date manipulation is crazy that is going on with this company. We called agin this morning and they are very stern and are saying that we need to call back again later today.We feel they are rushing to complete our complaint so they do not have to postphone the sale i even heard the department say we are going try and this done before the XX/XX/XXXX so they can go to sale but the letter say something different which iwill upload. My husban and i are on title to this property have always been since XX/XX/XXXX
