Complaint: My mortgage servicing company has repeatedly given me inaccurate information in regards to my mortgage loan servicing and loan modification package documentation. I contacted my servicing company when I fell behind on my mortgage payments. They set up an outlined repayment plan, and then waited 20 days to send a letter of acceptance which was 2 weeks past the due date of any payment plan down payment, so I missed the date and the subsequently, the plan was denied. I called back a second time to set it up again, and the CS rep miscalculated the repayment options, and then it was denied again. They then told me to submit a full modification package to see if maybe the modification would be accepted, but continue to be missing documentation and my loan is now in foreclosure. I have had the loan modified previously, and was unaware that they could not charge me a modification fee, but going through paperwork ... I was charges {$900.00} to modify the loan along with thousands of dollars worth of " misc fees ''. I also have several years worth of loan documents that are not currently available on my loan from its beginning ; 5 years of statements, payments, and tax records that can not be accounted for, as well as current years taxes and insurance bills that have not been paid and kept current. I have been billed by my local tax authority as well as my mortgage insurance company for monies due that should be paid from my escrow account.

Complaint: I received a solicitation from my mortgage company Ocwen Loan Servicing stating that our mortgage may qualify to remove the PMI from the monthly payment. We 've had the mortgage for 10 years never late and our house to date has appreciate from XXXX to over XXXX assessed value based on the comps on the block and area. We were very excited to lower our mortgage payment by removing the PMI. We wrote Ocwen back and agreed to remove the PMI. We received a letter stating to process the application we would need to submit payment of {$100.00}. We thought that was odd, but thought if would be a minimal investment. A few weeks later they sent a XXXX lady out to take pictures of our home. We received a letter from Ocwen about a month later stating that we would need to submit a principal amount to equal to 80 % of the value. They never sent any numbers or explanation. We were confused that after 10 years our home did not appreciate to the standard when we knew we purchased the home in XX/XX/2007 at a competitive price. We called Ocwen, they gave us no answers and shifted us around from person to person. We asked the XXXX what the numbers, she could not give us any numbers. We requested a written explanation where she said she does know if she could do that. This is when we feel, this is a deliberate alternate stream of income to Ocwen taking advantage of their customers. A few weeks later we received a letter saying our house is only worth {$140000.00} and we would have to submit over {$34000.00} in principal to get the PMI dropped. I smell a rat. Van you please investigate. Ocwen has not responded to BBB nor the Florida State Attorney General about this concern. Complaint: Entered into an agreement with homeward residential in XX/XX/2016 to refinance a mortgage. Complied with every request ( many excessive ) for documents, only to have Homeward continually stall and drag out the process. The end result is that I have spent thousands of dollars to refinance, without any action by Homeward to approve/deny the refinance. The rate lock expired - we were guided to extend at " no cost to us '' but Homeward added another point to the closing costs. The rate lock expired a second time, again Homeward added another point to the closing costs. Homeward 's actions show they never had any intention of following through with this refinance, and provided fraudulent documents to keep me from going with another provided. This amounts to a financial loss of more than {$100000.00} due to Homeward 's fraudulent and deceptive business practices.

Complaint: in XX/XX/XXXX, Ocwen accelerated our note despite no default. We won THREE times due to NO STANDING & once for false caption ; their next appeal is next month. In the course of defending we found they are allegedly representing a dead entity using proof of ownership somehow provided by a lender that also does not exist. They have a copy of an unendorsed note only - that I provided. They have used a rotating cast of fantastical undated allonges that are voided/replaced/reordered based on each loss to try to correct the deficiencies found by the court. The final allonge - undated but alleged to have occurred in XX/XX/XXXX was signed by a former handyman who only began working for Ocwen in XX/XX/XXXX - and is now signing as the trust 's attorney in fact.In XX/XX/XXXX they recorded an " assignment '' allegedly created by MERS on behalf of a lender defunct for 10 years, directly into a trust that has been closed for 10 years. The assignment instructions say return to Ocwen - yet the address given is XXXX in Idaho. The " investor '' MERS listed PRIOR TO the assignment WAS NOT the alleged conveying lender on the doc ( and in fact that lender has never been listed in MERS. ) The investor MERS listed AFTER the alleged assignment is NOT the recipient trust to whom they claimed it is now assigned. They have recently " discovered '' a new loan mod that we allegedly signed in XX/XX/XXXX ( with a fax number at the top belonging to XXXX - dealmaker for the alleged owner trust ) My husband 's signature is obviously, comically forged and my signature appears to have been cut and pasted. The alleged loan mod did not change our payment - it simply changed the interest rate of the original note. They have terrorized us for five long years. Their lawyers went to my child 's school, they tried to keep my son from XXXX, have broken into our home, hurt our dog, and have repeatedly gotten me fired. They send open carry " inspectors '' to our home ( and claim we owe them for dozens of such " inspections '' and property valuations, ranging in price from XXXX, as well as yearly forced place insurance despite the fact that we have never had a gap - at XXXX per year ) In looking over these charges recently, it looks as though they may be keeping multiple sets of books. For example, on appeal at the end of XX/XX/XXXX, the alleged " escrow balance '' was {$4000.00}. Yet on the Spring XX/XX/XXXX " preforeclosure '' notice - the escrow balance was {$37000.00}, while the " monthly bill '' for XX/XX/XXXX lists the escrow balance. as {$17000.00}. They have provided four different " transaction histories '' since XX/XX/XXXX - all of which conflict with one another, yet all of which, amazingly, show our payments being made and received each month! The ledger provided to the court in XX/XX/XXXX had NO BALANCES. The ledger provided 3 months later in the appeal brief ( the XX/XX/XXXX TXN History ) shows that in XX/XX/XXXX the escrow balance was XXXX - but after an alleged 4,000 disbursement, the escrow balance the balance ballooned to {$21000.00}. Ocwen stopped sending monthly statements in XX/XX/XXXX and the XX/XX/XXXX ledger stops on that date. They resumed sending demands in XX/XX/XXXX and sent another preforeclosure notice in XX/XX/XXXX - then afterwards CLOSED OUR ACCOUNT WITH THE CREDIT BUREAUS. ( closed since XX/XX/XXXX ) Then the next month, the new FC mill started FC proceedings. The XX/XX/XXXX ledger also stops in XX/XX/XXXX XXXX and has no escrow or principle balances ; they sued for note amt. of {$240000.00}. The XX/XX/XXXX ledger has a fee bal. of {$14000.00}, escrow bal. of {$21000.00}, prin. bal. of {$260000.00} ( they added XXXX to bal. XX/XX/XXXX as cost of loan mod - which we only did b/c they claimed we had n't paid in 6 months UNTRUE but it was agree or FC. ) I have bank certified proof of no default & all allegations, including letters from Ocwen 's ombudsman who LIED about original contractual amt., default & more.

Complaint: I am a XXXX, representing a homeowner in the short sale of their property. We have been trying, myself and the homeowner, to communicate with and get an update from Ocwen regarding the status of the short sale approval. We have provided all documents requested - MULTIPLE times. Every time we get someone on the phone, most recently it was Agent # XXXX, just this morning, they disconnect our call! As soon as I began telling this person that we had already submitted the document she was requesting, multiple times, the phone clicked off, dead. The same, exact thing has happened multiple times to me - bu ONLY when speaking with Ocwen " relationship managers ''. They never call back and when we attempt to call them, we can never speak to the same person, and within a few minutes of explaining that we have already submitted every document they are requesting, they hang up on us! I am a XXXX. I 've XXXX in my career. This behavior from Ocwen is notably different from all others I 've dealt with. I can only assume they are intentionally trying NOT to allow the short sale and would prefer to foreclose on this property. I DO have a purchase contract on this home, from a pre-approved and committed buyer. We are ready to proceed and close this sale but Ocwen is not cooperating with us. They have made it impossible to proceed by continually requesting the SAME documents over and over and then hanging up on me when I explain I 've already submitted those documents. I have time-stamped emails proving that I have submitted the documents at least 4 times, some of them more than that. This has been going on since late XXXX 2016. I have reached out to Ocwen at various email addresses : XXXX, XXXX, XXXX, XXXX. I never get a reply back other than to request the same documents I just sent them. We are going in circles and I need the CFPB to step in and help us.

Complaint: In XXXX of this year, Ocwen agreed to pay XXXX XXXX and provide {$190.00} XXXX in debt forgiveness in settlement with the State of California for amongst other things, Failure to submit correct information to credit reporting agencies on borrowers, jeopardized borrower 's ability to obtain loan modifications, provided inaccurate information on notices of default, Robosigning affidavits in foreclosure proceedings, Please notice that my monthly Ocwen statement of XXXX/XXXX/XXXX stated that my reinstatement amount for that date was {$280000.00} However on my credit report, the amount past due was entered as record for the amount of {$300000.00}? Can you or your client XXXX Bank, or it 's servicer Ocwen LLC please explain the difference or reason for the markup? ( see attachment ) Secondly, on the delinquency notice dated XXXX/XXXX/XXXX, My mortgage reportedly first became delinquent on XXXX/XXXX/XXXX, however, if we examine the initial default letter from Litton, I was deemed in default of my loan as the borrower on XXXX/XXXX/XXXX. ( and we should be mindful that on the credit report Ocwen, not Litton assumes ownership of this loan since it was initiated on XXXX/XXXX/XXXX ) ( see attachments - credit report and delinquency notice ) Also, Ocwen robosigned my affidavit, with the incorrect birthdate of course, while refusing or ignoring to acknoweledge recipt of the affidavit that I sent you and Ocwen dated XXXX XXXX XXXX. Complaint: Greetings, Our loan service company for our 1st and a previous 2nd mortgage is Owcen. We filed a Chapter XXXX Bankruptcy in XXXX of XXXX. The past due amount on our 1st mortgage ( about {$33000.00} ) and the full balance of our 2nd mortgage ( about {$72000.00} ) were included in the Chapter XXXX filing. Our attorney advised us that the 2nd mortgage balance would be " stripped '' once we were discharged from the plan since there was no equity that Ocwen could be paid making the 2nd mortgage unsecured. We were successfully discharged from the plan in XXXX. We were therefore not liable for paying the balance of the second mortgage. Ocwen sent us a form XXXX for the 2nd mortgage balance ( ( {$66000.00} ). The reason code they used was XXXX in box XXXX on the form which is their " identifiable event code ''. This seems to indicate that they just decided not to continue collection. There is a code " XXXX '' that they could use which denotes the cancellation of debt was due to a bankruptcy. I called their ombudsman office and they explained that they could not rescind the form. That 's ok with us but we feel that they should correct the form with code " XXXX '' in box XXXX of the form since the balance of the second mortgage was discharged due to bankruptcy. I prepared our taxes for XXXX and this form XXXX increased our taxes owed by {$27000.00}. We feel this is unfair since we successfully completed the plan and the IRS makes provisions via form XXXX for this circumstance. If Ocwen will make this minor modification to change the code in box XXXX of their XXXX to " XXXX '' and send us an corrected copy, then we should be fine. We really need some assistance to make sure that this is accurately reflected so we can file our taxes for XXXX.

CFPB is not allowing me to dispute response from XXXX XXXX with Ocwen Loan Servicing, Consumer Account Analyst, Office of the Consumer Ombudsman letter dated XXXX XXXX, XXXX. Ocwen is using XXXX XXXX to blow smoke circles for them while they hide behind there computers covering up the facts and the truth again only to level attempts to cover up Ocwen continuous fraud against me and several other victims. Ocwen scums may think its going to work but as always it will always caches up with them. Ocwen Loan Servicing use Homeward Residential as a tool to use fraud upon the court, using forged fabricated documents and robo-witnesses to seek fraudulent judgment, then later the cool XXXX thought it would n't come back to bite them, boy it will bite like XXXX. Ocwen scums say they were not involved in the XXXX XXXX Bank vs XXXX XXXX case but they know XXXX well that was the secret tactic plan they used and thought they get away with it. I am glad Ocwen is responding to my consumer complaints with all lies. New evidence will bring you down. I will be filing a new XXXX lawsuit, If Ocwen is able to pull off another fast XXXX against using forged fabricated documents I will never stop until my matter reaches the XXXX court and be given my right to a fair jury trial. Recently, I found out who the individuals working for Ocwen who have committed so much fraud against me and my family. I know who you are and now its time to sue you. I 'm glad Ocwen was able to recently settle CFPB investigation into Ocwen 's servicing practices. ; ) I would like to have the right to dispute Ocwen Loan Servicing 's robo-worker responses. Please provide XXXX with your findings, they have not received a response from you. ; )

Complaint: I have an interest only loan plus I have an escrow account. The loan is being serviced by Ocwen Loan Servicing. The interest plus escrow is approximately {$980.00} per month per the loan modification completed in XXXX XXXX. I received my statement for the payment due XXXX/XXXX/XXXX and there is an additional fee of {$1400.00} due. It is listed as Fees/Other Charges on the mortgage statement with no additional explanation. No letter explaining what this additional fee is for. I contacted customer service and was on hold for a lengthy time while she researched the issue. She finally connected me to the Escalation Dept where the Manager placed me on hold so he could contact the Cashiering Dept. When he came back he told me he needed to research the issue and call me back. He called me back the same day to tell me Ocwen was calculating the interest incorrectly and that I owed Ocwen {$1400.00} due to Ocwen 's error and as a courtesy they could add this amount due to my loan balance. I requested additional information as I have an interest only loan and this interest error now impacts my XXXX taxes. I requested a full accounting of when this error began, how they calculated the interest and what the interest should have been. I have not received any of this info. All I have been told is that I owe this money that is due to Ocwen 's error.

Complaint: I submitted a loan modification back on XXXX XXXX, XXXX and was denied XXXX XXXX, XXXX. I have fallen behind on my monthly payments for various reasons. I have not had a stable income because I have been employed and unemployed throughout the years. I lost my job in XXXX and all of XXXX I was unemployed. I got by on a day to day basis depending on the rental income that I would receive once a month but as of XXXX XXXX the tenants stopped giving rent. My son who was also helping me financially moved out and I have had to stay and deal with the tenants who are occupying the home without paying. I have seeked helped to evict the tenants but it takes money ; which is something I do n't have. I 'm doing my best to try and save my home. I have thankfully been blessed with another job but I do not have the money to reinstate based on the circumstances that I have mentioned. Please help me save my home as I do n't know where I will go if I lose it.
