Complaint: For the last 5 years, we have been making mortgage payments to Caliber Home Loans twice a month via our checking account online banking application, in the amount of {$1000.00}, on the XXXX and last day of the month. Caliber, up until XX/XX/2019, would place the first {$1000.00} in a suspense account. When the second {$1000.00} was received, Caliber would then apply the {$2000.00} to the {$1800.00} due and credit {$140.00} to principal. This practice is in accordance with our mortgage documents and the disclosures provided on Caliber Home Loan monthly statements. In both XXXX and XX/XX/2019, Caliber applied the first {$1000.00} payment to additional principal, rather than place the funds in a suspense account. When the second {$1000.00} was received, it appeared that the monthly mortgage payment was short by {$850.00}. Collections calls began on the XXXX of XXXX and XXXX. In both cases, we spent extended periods of time on the phone with Caliber telephone to correct the payments so they are posted and applied accurately. Caliber Home Loans is in violation of our mortgage agreement and is providing deceptive disclosures to their customers on their monthly account statements. The teller we spoke to on XX/XX/2019, XXXX, stated on our call that this is a known problem being experience by a number of customers

Complaint: I received an Escrow Account Disclosure Statement dated XX/XX/XXXX indicating an escrow shortage of {$3900.00}, making my monthly mortgage payment increase from {$1500.00} to {$1900.00}. This is highly unexpected, as my taxes did not increase by {$3900.00}. During multiple calls with the mortgage company ( on XXXX, XX/XX/XXXX, XXXX, and XX/XX/XXXX ) I tried to explain that the shortage is likely due to the fact that the mortgage company made a disbursement in XX/XX/XXXX of {$4800.00} which is the entire tax bill for the year, instead of making quarterly tax disbursements as the mortgage company had done in the past. The mortgage company did not seek my consent to making a yearly payment instead of a quarterly payment. Even after agreeing to go back to making quarterly tax payments, when the mortgage company did a new escrow analysis, they found my escrow shortage to be {$280000.00}, which is still puzzling as my taxes did not go up by that much. The mortgage company is spreading the shortage over 60 months, but still, I do not understand why the shortage is so big. I am afraid the mortgage company is charging me more money than they should be. For reference, my taxes have been {$4900.00} in XXXX, {$4800.00} in XXXX, and {$4700.00} in XXXX. And my escrow shortage has been {$250.00} in XXXX and {$190.00} in XXXX.

Complaint: I took out a loan in XX/XX/XXXXwith XXXX XXXX XXXX XXXX XXXX XXXX for {$310000.00} and the balance today is {$330000.00}. The loan was sold to XXXX XXXX ( XXXX ) in XX/XX/XXXX and they were showing a much lower balance. Caliber Home Loans now claims to be servicing the loan for some XXXX Master Participation Trust which is just an Agent allegedly pertaining to XXXX XXXX. They securitized my loan and did not send me a copy of the IRS filing documents as requested in the following letter to them. CALIBER HOME LOANS XXXX XXXX XXXX MASTER PARTICIPATION TRUST ( AGENT ) XXXX XXXX, XXXX, XXXX. XXXX XXXX, XXXX, XXXX XXXX XXXX, ET AL Dear Sirs : We attach a copy of a Court Order and this Qualified Written Request ( QWR ) for an accounting of the loan you are alleging to be servicing on behalf of Fannie Mae. We would like a complete accounting and a copy of the cancellation of debt when the note was securitized filed with the IRS form per 26 USC ss. 108i from the Trustee, Trustee Corps for our Attorneys as stated below : This is an IRS form that servicer trustees must file who put your mortgage into a stock pool. Please use my cusip number ( s ), to prove that I didn't sign a mortgage but an investment contract that I was made an accommodation party to but not a participant. Did you sell these unregistered securities and are in possession of contraband. Also there should be Cancellation Of Debt ( COD ) when the mortgage Security was converted to a stock ( 26 USC ss. 108i ) ; Did it make it into the REMIC? Thank you and we wait your reply. Closing company having extremely hard time to contact CALIBER, it can only done thru email and can take 60 to 120 day 's for respond. Complaint: Received a letter from Caliber Home Loans of payments changes without given explicit explanation of the payment changes. If the change is because of escrow or taxes, they should provide the possibility to pay that adjustment. I believe to just notify changes without explanation is a really bad practice of the mortgage company, which can allow making any changes potentially illegal charges. As a matter of fact, I will pay interest for that amount because of this bad practice.

Complaint: We applied for a mortgage with Caliber, through our realtor XXXX XXXX, who has worked with them in the past. They asked all type of documentation from both of us ( my father in law and myself ) such as taxes returns, retirement, years at job, proof of income. We provided them with all in a timely manner. We soon got pre-approved and a deposit was submitted ( {$2600.00} ). Right after an appraisal ( {$600.00} ), an inspection ( {$450.00} ) and re-inspection ( {$150.00} ) after a repair that we were asked to do in the front of the house ( exterior ), because the house was sell " as it ''. We did it all, and we got our first closing date ( yes, we ended it up having several closing dates! ) for XX/XX/XXXX. Couple of days prior, our realtor informed us that the owners of the house were asking for one extra week to be able to move ( they were still occupying the house ). We agreed, trying to help them. Just to learned after the fact that it was a huge mistake of our realtor. " When you have a closing date, you close ... .and then you make extra arrangements. '' We didn't know, our realtor should. A new closing date was set for XX/XX/XXXX. I asked a week off in my job to paint the house and get all situated. Didn't work. Couple of days before the XXXX, XXXX XXXX and XXXX XXXX ( Caliber staff ) started sending me emails and text asking for information that they should know from the day they run our credits scores. They also started using phrases such as " we trying '', " you pray '', " we never being denied before '' ... Again we did everything as they asked for, and we got a third closing date XX/XX/XXXX. More documents request, new tentative date XX/XX/XXXX. It started feeling like a bad joke by then. We received a letter from Caliber saying that our credit line has been denied. Still XXXX XXXX kept communicating with us and talking with the underwriter and buying time. She told us that the underwriter will wait for us up to XX/XX/XXXX. It never happened. They were clearly unprepared, they didn't analyze all the variables of our situation from the beginning. They just pressed the bottoms without foreseeing the consequences of their lack of professionalism for our family. We have XXXX minors in the house. They have 100 questions a day about the house they went to see with us. Our home is 90 % packed and ready to go since XX/XX/XXXX. My XXXX years old is homeschooling for the first time ever due to lack of transportation ( one of the main reasons for our moving ). They also urged us to sign incredible amount of documents, one of them including a contract of 30 days to close, and if unable to close the other part will keep the deposit money. We never been verbally informed about it by the realtor or Caliber, and we also learned after that its almost never 30 days, but 45 or 60. I called my realtor XXXX XXXX and I called XXXX XXXX and left a voicemail for both of them asking for a meeting. Never received a call back. I decided to email both of them, no answer what so ever. Not sure if any other factors as the age of my father in law ( XXXX ) or my ethnicity ( XXXX ) played a roll in their decision. But I know it shouldnt. Since then, we tried to apply for another mortgage in two different companies. They both gave us a clear answer within two weeks or working with them. No false hopes, no misunderstandings. They did their homework and they treat us with respect of our time and money. Both tell us that the prior denied with Caliber impacted their decision.

Complaint: Back in XXXX of XXXX I submitted a prior request to your office. My XX/XX/XXXX mortgage payment was reported 30 days late in error. At that time, the company did admit an error with their system, the payment I did in fact make online on XX/XX/XXXX was delayed in posting to XX/XX/XXXX by their own admission and agreed to take it off and they did. Subsequently the error was corrected and the complaint closed. Then a year later, they go back and reported it again late after not even servicing this loan since XX/XX/XXXX when it transferred to XXXX. I immediately called them on 2 separate occasions this year and Caliber on each occasion stated yes it was an error and that per RESPA laws you can not report a payment late within 60 days of a transfer to a new servicer. I reminded them of this prior complaint with your office and was reassured that it would be corrected once more. It still has not happened. At this point I would like them fined. They can not keep changing my reporting or refuse to correct their system error. It is in writing that it would be corrected. It was and for whatever reason a year later after not even having the loan, they reported the payment again late despite the admission of their system error.

Complaint: I had my mortgage payment setup to automatically send from my bank to the mortgage company Caliber Home Loans on the 1st of every month. In XX/XX/XXXX/XX/XX/2018 my mortgage payment changed because the property taxes changed. This caused my mortgage payment to increase. However, because Caliber Home Loans had purchased my Loan from XXXX XXXX Loans I wasnt correctly receiving notifications of these changes to my mortgage as they were not sending me the statements. Additionally, they were supposed to be sending me emails but they werent. This resulted in my underpaying on my mortgage account on XX/XX/XXXX/XX/XX/2018 because I didnt know to update the automatic payment I was sending. When this happened Caliber Home Loans reported a 30 Day late on my credit. As soon as I became aware of this I paid the mortgage account current, When working with Caliber they refused to take responsibility for the failure to notify me of the change in my mortgage payment and refused to remove the 30 day late from my credit. I have attempted several times to dispute the 30 day late without success. This was not a 30 day late, the payment was made, but the payment was short because of Calibers failure to notify me of the change in payment amount. The account has since been paid in full and closed, and Caliber is still refusing to correct this error on my credit that was a result of their negligence and failure to notify me in the changes to my mortgage account. I had full intentions of paying for the mortgage and had I been properly notified of the change the payments would have never been short.
