Complaint: I went into XXXX XXXX XXXX XXXX XXXX on Sunday, XX/XX/XXXX. The dealer, XXXX XXXX, is a friend of my sister, so he told her that it would be okay for me to come in outside of the scheduled hours of operation. When I arrived at about XXXX XXXX., he had already had a car pulled out and went to put gas in it. It was the only option that he gave me so I assumed that he and my sister had already discussed my money. He was inside processing information and contracts and looking over information that I had given him. He asked me to come to the computer to electronically sign the forms ; he did not go over any information. I am a first time car buyer as a college student, so I was not sure exactly how things would go. Unfortunately, I did sign the paperwork, but no money was taken. I also never took possession of the car because the dealer said that one of the mirrors had to be fixed. Upon the next day, Monday, XX/XX/XXXX, I had an unexpected event happen regarding school and the money was taken out of my account. I was unable to notify the dealer for the fact that I had class and was not dismissed until XXXX. In addition to that, when I spoke to my father that same night, he had asked me if I ever looked at the XXXX XXXX XXXX price of the car ; I had not because I was not sure of any of that and we did not go over the history of the car. After my father told me to check because it seemed to be a bit much for the specific car, I found out that the XXXX XXXX XXXX maximum price for the car was about {$8000.00}. The next day, XX/XX/XXXX, the dealer called me and said that he was missing my miscellaneous mail confirming my address and money. I did not take the call because I was at work, but I did call when my shift ended and I was on my way to school. I told him of the situation and asked him if he could inform my on the steps that I needed to take to get the financing reversed. He stated that there was nothing that he could do and it was my my car since it had already been financed, He told the same thing to my mother when she called. I, then, took it upon myself to call the financing company, Credit Acceptance, to get more information on the financing of the car. The representative told me that the dealership could indeed cancel/void the finance. My mother and I then called back to speak with the dealer and he said the still insisted that there was nothing we could do. Following this, my mother and I spoke to about three representative that gave us multiple answers. One representative filed a complaint on my behalf and told me that someone would be contacting me within three days. She informed me that it would be wise to send in documentation showing that I had not put any money down for the vehicle and any other information that I wanted them to know. I sent in both my income statement and the XXXX XXXX XXXX price, even one with the color the car. It was over {$1000.00}. I spoke to a representative one again on Thursday, XX/XX/XXXX, and I was told that there was nothing they could do. The car had not been financed without the miscellaneous information to confirm my address and they were aware that I had not put any money down but it was still nothing that they could do. I then asked if he could do anything without my information and the representative told me that there were other steps that he could take. Over the days of Friday, XX/XX/XXXX, and Sunday, XX/XX/XXXX, I had reviewed the contract and Section G of the contract is entitled " Cancellation of this contract '' states, " You may cancel this contract at any time by notifying the Administrator or Lienholder. Your cancellation notice must be accompanied by the then-current Vehicle mileage [ I never took possession of the car ]. If the contract price was financed, any and all refunds will be paid to the Lienholder. '' Section I : Refunds and Charges states, " If the contract is cancelled within the first thirty ( 30 ) days past the Vehicle/Contract Sale Date, You will be entitled to a full refund of the Contract Price. '' Per the definitions at the bottom of the contract ( Section J ) : " Contract '' or " Service Contract '' means this document in its entirety.
" Contract Price '' or " Provider Fee '' means the price of the Contract as specified on the first page of the Contract.
" Lienholder '' means the financial institution ( if any ) extending the loan/lease amount to the Contract Holder.
" Vehicle '' means the Vehicle covered by the Contract, as identified on the first page of the Contract.
" Vehicle/Contract Sale Date '' means the date the Vehicle and this Contract was purchased.
I do not require a refund because I gave no money whatsoever to the dealer or dealership. My desire to cancel all occurred within the first 48 hours. On today, XX/XX/XXXX, the dealer, XXXX XXXX, contacted me via text while I was at work and stated, " Your car needs to be picked up by tomorrow this deal not gon go away you sign a legal contract. '' I replied, " Sir, this legal contract also states in Section G : Cancellation of the Contract that 'you may cancel this Contract at any time by notifying the Administrator or Lienholder. Your cancellation notice must include the then-current vehicle mileage [ which I never got the car ]. If the Contract Price was financed, any and all refunds will be paid to the Lienholder. ' It also states in Section I : Refunds and Charges that 'If the Contract is cancelled within the first thirty ( 30 ) days past the Vehicle/Contract Sale Date, You will be entitled to a full refund of the Contract Price. ' '' The dealer replied and stated, " Contract only states that u can cancel gap or extended warranty if you don't believe that wait for the repo to hit your credit I tried to be fair on this but it's on you. '' He texted me again and said, '' Read that again cause I'm telling you it's your car I'm try to save the repo from hitting you credit if you wasn't XXXX sister I would even say nothing about I'll just let the repo man pick it up just trying to gave u fair warning. '' My final message to the dealer stated, " I would not say fair. You are aware of the fact that U am a college student. I do not have the money in my account and I said that. If I were aware of the fees, I would not have wasted your time or mine. You also lied to me and said that there was nothing you could do when multiple representatives from Credit Acceptance that the dealership can cancel it. The car was not financed. You, yourself, also put on the contract that I made a down payment of {$2000.00}. My job will be terminated as of XX/XX/XXXX at the moment. So, whether you were being " fair '' or not it would hit my credit. Unfortunately, I am going into the accounting profession and it may affect my career some but it is ultimately my fault. Per the definition in the contract : " Contract '' or " Service Contract '' means this document in its entirety.
" Contract Price '' or " Provider Fee '' means the price of the Contract as specified on the first page of the Contract.

Complaint: On XXXX XXXX, XXXX I started a loan for a used XXXX XXXX XXXX. I paid the balance that was a total of around {$11000.00} down to {$3800.00} my last payment was XX/XX/XXXX. The monthly payment was {$300.00} for a total of four years. I contacted the business because the amount paid down was incorrect. Suddenly, it had increased by a few thousand dollars. The loan was through a company called Credit Acceptance.
I was told by their customer service line to just continue making the payments as normal and that they would start a ticket to correct the information. I continued to call but I was given the same answer over and over. Eventually, they told me that it was interest but that was incorrect. I then decided to check the customer service reviews on the BBB website and there were a ton of disputes.
I stopped making the payments because the debt paid down increased once again. Their customer service was not only poor but I dealt with people who were very rude and who threatened to take possession of my vehicle the day a payment is late.
I spent hours and hours attempting to resolve the situation and in the end I was at a loss.
Fast forward to after I halted the payments and according to my credit score I owe {$9400.00} and it keeps increasing even though it is in the " closed, charged off, '' status.
I get phone calls, sometimes multiple times a day, from companies that claim they work for Credit Acceptance. They're rude, I've had threats of garnishing wages and multiple continued calls at early times in the morning.
I was going surrender the vehicle a long time ago but after I saw the price increasing I asked what could happen and I was told that the price would continue to increase until I paid it off entirely. So, I was stuck. Surrender the vehicle and continue making payments even though the amount would increase or keep the vehicle, never drive it, and continue to receive harassing calls and watch the amount increase on my credit report ...
What do I do? No matter what I've been told that the amount I owe will increase. So, I'll never pay off the owned amount and I've lost the use of a vehicle.

Complaint: On XX/XX/XXXX, I applied for an auto loan through the car dealership where I purchased a XXXX XXXX XXXX. The dealership, XXXX XXXXXXXX XXXX, located in XXXX California, is a privately owned dealership and the salesman, XXXX XXXX misled both myself and my co-signer who is my ex-husband, stated that the vehicle was priced at {$6900.00}. After the salesman ran my credit and attempted to obtain a loan through their bank, I was informed that my application wasn't accepted. I was then informed that he would attempt to obtain financing " in-house '', and that in addition to increasing my down payment from the initial {$1500.00} that I had brought with me in cash, that I would need a co-signer. I agreed to increase my down payment by {$1000.00} and asked my ex-husband to co-sign for me. The salesman also instructed both myself and my co-signer that we were to tell the finance company and that the paperwork ( i.e. ; loan application and subsequent documentation was to show that the vehicle is being stored at an address where I no longer resided. My ex-husband and I do no live together and the salesman was made aware of this, however he still insisted that for the sake of the loan being approved, that the paperwork was to reflect that the vehicle was being stored at an address that I did not reside at. Upon receiving approval for financing, and after the paperwork had been started for the completion of the sale, the salesman insisted that if I didn't purchase the almost {$1500.00} 1-year warranty from a third-party, that I would have to pay an additional {$500.00} before being able to drive the car off of their lot. Both the salesman, and the owner of the dealership, a man by the name of XXXX, assisted myself and my co-signer in getting all of the required signatures to complete the transaction. I was informed by the owner that the vehicle that I was purchasing was a good vehicle that ran very well., and that in the event that I had any problems with the car, that I was to contact the dealership first to see if the problem could be resolved. My first payment was exactly 30 days from my purchase date. Exactly 2 weeks after purchasing I had been on my way to work when I began having problems with the car. I contacted the dealership immediately and was informed by someone named XXXX that the mechanic wasn't working on the weekends and that I would have to talk to the owner the following Monday. I received a call from the owner the following business day and explained to him what had been happening. I informed him that I could not put the car into gear and that it had broken down at a nearby business and that I would like to have it towed to his dealership to be looked at, which was exactly 11 miles from where the car had been parked. The owner then informed me that it was my problem that I had to figure out a way to get the car towed to his dealership on my own and that he didn't have a tow truck that could retrieve the vehicle. I then mentioned to the dealer that it had been less than 2 weeks since I purchased the " lemon '' at which time he began shouting at me over the phone saying that he didn't have to help me and that the car was fine when I drove it off the lot and then proceeded to insinuate that it was my fault that the clutch wasn't working. I also mentioned that I was charged for Emissions Testing in the amount of {$50.00} and that California law requires that the seller of the vehicle pay for any Smog fees before selling a vehicle. I have yet to receive license plates and a registration card for the vehicle, even though the salesman said that the registration process would be taken care of by the dealership. Since XX/XX/XXXX, I have been unable to go to work and make money necessary to make my car payment. I have lost out on income making opportunities as well.

In XX/XX/XXXX my transmission blew so the company Credit Acceptance would not offer any assistance so I had voluntary repo the company did not take proper action as the NC law states about repos Currently I have learned they sold the car in a car auction XX/XX/XXXX 0r XX/XX/XXXXhowever through theUCC and State RISA and MVISA statutes a deficiency can not be claimed unless all of the required notices were properly and timely given and all of the allowable redemption and cure time limits were adhered. I received no notices also they are reporting inaccurate information like this account is new this account is at least 8 years old which should have been deleted off my credit file which I am requesting that Credit Acceptance Corp Delete in the next 15 days such we all can agree they have not took proper action in notify me of the debt also did not send notify me when the vehicle was auction off and no notification when reporting on my credit file 5 days prior and reporting as if it is a new account. I have attempted to dispute with the Credit Bureaus at least 4 times I was susscessfully with XXXX but XXXX and XXXX it comes back as verity but not ( validation nothing with my signature ). I appericate the CFPB help in this matter.

Complaint: My name is XXXX XXXX, I am dealing with a situation with XXXX where there is a Repossession showing on my credit file that is not even under my social security number, though uses a like name and same DOB. I have had the credit bureau dispute the item with the creditor and have contacted the creditor directly and the matter has not been resolved to date. I made direct contact with the fraud department at XXXX in hopes to get an immediate action as I have done before but not with this particular account and I don't understand why it has not been removed yet. I do appreciate the help they have given me thus far as their fraud department has been very expeditious in other matters in the past few days so I have no real complaint about XXXX except why would they allow an account to be reported to my file in the first place when it so obviously had a different social security number attached to it? The company that reported the incorrect information is Credit Acceptance Corp. XXXX. They reported an auto repossession to my credit file with a different social security number and upon being contacted were so rude and disrespectful because I had no account information to supply for obvious reasons. I called them back again and was transferred to a young lady who was very nice and gave me the account number, the name used, verified the last 4 numbers of the social used and that the DOB was the same as mine. I supplied them with my name, address and contact number and the police report information and was advised I would be contacted within 72 hrs by their company. I called XXXX again to give this information, including the name of the lady I spoke with, but the account remains on my credit. I don't for my life understand why it was not removed as soon as they realized the social security number was not mine, it wasn't even close. Anyway, the battle continues as there are multiple accounts that do not belong to me that do have my social security number attached unfortunately for me. I hope my story helps someone else out there going through the same or similar situation. Stay on top of your credit and don't take No for an answer. It's your credit, your right and as long as we live in a society that rates you by a number on a report, you've got to make sure it's correct and the information is accurate.
