Complaint: I have been Paying Capital One the # {$3500.00} I owed. To date I have paid {$3400.00} But has tow situations happen : ( 1 ) my XXXX daughter hospitalized ; and ( 2 ) I was hospitalized for XXXX. I am a XXXX and these XXXX ( 2 ) were quite serious. I wound up having to have XXXX to correct this problem. In addition, I was denied XXXX XXXX to pay off the debt because of an impending strike with my employer. I received a letter of garnishment from my employer on or about XX/XX/2018, ( a month before my indebtedness ended ), XXXX XXXX University 's Payroll office. The attorney 's who filed XXXX XXXX XXXX XXXX XXXX for Capital One. Attached to this letter from the attorney 's for Capital One was a form for me to complete to ask for a court hearing, to dispute the situation. I filed with XXXX Municipal Court Civil Complaint to dispute the claim and received a court date of XX/XX/2018, since I had just given a payment. I showed up, but they did not. The magistrate ( judge ) told me that I should keep up with the case, since there was nothing she could do. I did. I went to XXXX XXXX XXXX, who I was making my payments through to call the attorney 's as suggested by the judge. My credit counselor and I waited on a telephone line for almost an hour for someone to pick up and discuss this with us. We never heard from them. I only had an hour appointment. The credit counselor said she would call me if she got a call back. She did not get a call back, so she did not call me. At XXXX XXXX on XX/XX/2018, in the mail, I received a letter and affidavit saying that they had filed to the court in writing. I called the XXXX Municipal Court and was told, I could re-file an dispute claim, once took a payment was taken from my check. However, there was nothing the court could do until this happened. Then, I called the payroll office to see how much money would be taken. I found out it would be 25 % or {$1400.00} from check, which will leave me without enough to pay bills. I am paid once a month. I am concerned, because the numbers of indebtedness is adding up along with court costs. XXXX State University payroll office says I them {$1600.00}, XXXX XXXX has chronicled payments of {$3400.00}, and Capital One had added another {$1300.00}, plus court costs. I should only owe may {$200.00} or whatever is equal to {$3500.00} not an additional {$1600.00}, and court costs. I received countless letter for XXXX XXXX XXXX even when I made timely payments, despite problems I had in the summer of XX/XX/2018-explained above. I asking that the garnishment be dropped beforeXX/XX/2018 before XXXX XXXX and I be allowed to pay the balance through XXXX XXXX XXXX I will make the payment on XX/XX/2018. We all have life a crises, but I have tried to make this up and XXXX XXXX XXXX have paid additional money with credits I have had with them to keep me up to date.

Complaint: I have had a credit card account of one type of another with Capital One since XX/XX/2011. I currently have two accounts with them. I had never missed a payment and rarely carried a balance with any of my credit cards. At the beginning of this year, in XX/XX/XXXX, I started to have some problems with transactions that I had not made appearing on the accounts. I went through the proper dispute steps with the company but was often transferred numerous times to various departments. I would be told the dispute was made and the transaction was removed only to have it placed back on the card or cards without any further information. Finally, in XX/XX/XXXX the transaction on my GM Capital One Card was permanently removed. When I talked to the representative on the phone I asked if both transactions were taken care of or if there would be anything else I needed to do. I was told that the company needed no further information from me and that none of the disputed transactions would appear on my account again. Two days later the transactions on my XXXX card were re applied. No further information was provided. No explanation or record or proof of anything. I called Capital One back and asked for a supervisor. I explained the situation and that I had just been told by phone that the situation was handled and nothing further was needed. The supervisor informed me that no notes of that kind were recorded on my account. He went as far as to tell me there was no record of me contacting the company on the day in question. Obviously my phone records would contradict that. The company has never provided proof of anything. I was then told that due to the amount of time that had passed there was nothing that they could do. I had followed every step that Capital One had given me. I was told it was taken care of. Due to their own lack of communication and the language barrier with their overseas operators Capital One greatly dropped the ball on this situation and has taken no responsibility. Basically at this point, they would have to eat the difference and they aren't willing to do that. Capital One advertises 100 % fraud coverage constantly. They have not only screwed up my account but breached our agreement. When Capital One added the transactions back to the account in XX/XX/XXXX I told them I wouldn't pay anything further until it was straightened out. I can not pay a balance that isn't accurate just because they say so. During that time they have added numerous late fee and interest charges. My account is currently so out of whack they are wanting {$680.00} to keep from charging it off. All they had to do was remove charges that were not made by me. The only information I have bee given is that the purchase were for children 's clothes or toys from a company in XXXX. I don't have any children and I certainly never ordered anything from XXXX. In the past year I have reported this to the XXXX XXXX XXXX and the credit bureau sites. The XXXX XXXX XXXX asked for a response to their response which was Capital One saying they could find no such transactions, when in fact it was the last transaction posted on the account. I wrote the response within the allotted time and never heard back from Capital One or the XXXX XXXX XXXX. When I turned in a dispute to XXXX, Capital One responded back with how they didn't see any disputed transactions on the account and that dispute through credit sites like XXXX were often not initiated by the card holder. I have no idea what that even meant, but it was obvious that XXXX nor Capital One had any desire to try to correct the situation. The transactions were easy to find with the corresponding dates they just have no desire to correct it. The transactions were corrected on the GM card but not the XXXX card which makes this all the more confusing as to why this has been so hard to correct. I just want my account and credit restored. I had a XXXX credit rating before all of this happened and as I said had never missed a payment. I now have a XXXX credit rating. This has left me unable to buy a new vehicle or pursue employment in the XXXX sector in an attempt to transition from XXXX XXXX. This is greatly affecting my life and taking away my freedom as an American simply because of a greedy credit card company. There isn't a cause for this other than a large corporation that outsources their labor to foreign countries and doesn't require them to speak English.

As I just mentioned, my mother passed away XX/XX/XXXX in her home in XXXX, XXXX At the time of her death I was XXXX and so I paid XXXX to to be XXXX to come home and deal with the loss of my mother. Subsequently, my mother had life insurance and therefor a claim needed to be initiated in order to receive payment. My brother and filed our claims to receive payment, however on XX/XX/XXXX I was XXXX to 18 months of XXXX time in XXXX County, XXXX for the unresolved matter that I was home on XXXX for when my mother passed away. My brother took full advantage of my situation and went to my home address, stole my check from my mailbox and EXTRAORDINARILY somehow did deposit MY check made payable to myself into his Capitol One Account with HIS name attached to HIS account that I have no association with whatsoever and of-course it was illegally done. I've brought this matter to the attention of Capitol One on XX/XX/XXXX when I was released from XXXX my XXXX and learned of what my brother did. Included in my supporting documentation is a copy of the check both front and back with my brother 's social security number, phone number, his Capitol One account number, the date of deposit and my forged signature. I have an affidavit of forgery that I signed stating and reiterating the fact that the signed signature is not my own, I've included a copy of my license and my passport that all reveal my signature along with the affidavit of forgery. I've been dealing with this issue for about 4 months to no avail. Furthermore, I received a response to this issue from a woman named XXXX XXXX that gave me her phone number and work hours as a person of contact on XX/XX/XXXX. As of today XX/XX/XXXX I still have not heard from XXXX XXXX nor Capital One, Ive called XXXX XXXX nmerous times at the number and extension provided and have left messages again to no avail. It seems as though Capital One just sent any old response to have this case closed.

Complaint: I applied for the Capital One Spark Miles Business credit card for my business purchases during the XXXX XXXX week. I received the card on Monday XX/XX/2018. I called to activate the card and uploaded my driver license as requested. I called again and was told they will hold my card several days before I can use it! I've never met any credit card company doing this. Capital One is crazy. I have provided everything they need. But they still won't allow me to use the card until after the shopping season?! I heard a lot of bad words about Capital One before. Now I learned it myself.

Capitol One a. I called Capitol One. They do not have any active credit card with my SSN other than my valid XXXX account. b. They were not able to identify another account under my name. c. Capital One gave me the following credit bureau number to contact : i. XXXX : ( XXXX ) XXXX II. XXXX a. XXXX put a fraud alert on my account through the automatic system. b. When I got a live person : i. XXXX was unable to help me with the account. The person I talked to only had the same information that was available on my credit report. ii. He gave me the XXXX Dispute phone number : ( XXXX ) XXXX and a follow-up number : ( XXXX ) XXXX iii. When I called the Dispute phone number, the person would not give me the full account number ; however, the last 4 digits are XXXX. ( XXXX ) iv. XXXX is submitting this as a fraud investigation. They will contact Capital One as part of the investigation. v. They will mail a copy of the investigation results within 30 days. vi. They suggested that I file a police or FTC report for this fraud.
